Does Article 1[(1)](b) of Council Directive 2001/23/EC (1) of 12 March 2001, in conjunction with Article 4(1) thereof, preclude an interpretation of the Spanish legislation intended to give effect to the Directive, to the effect that a public-sector undertaking, responsible for a service central to its own activities and requiring important material resources, that has been providing that service by means of a public contract, requiring the contractor to use those resources which it owns, is not subject to the obligation to take over the rights and obligations relating to employment relationships when it decides not to extend the contract but to assume direct responsibility for its performance, using its own staff and thereby excluding the staff employed by the contractor, so that the service continues to be provided without any change other than that arising as a result of the replacement of the workers performing the activities and the fact that they are employed by a different employer?

Notes that the former Executive Director of the Agency wrote to the Agency on 28 December 2010 outlining the activities which he was intending to take up at the end of his term of office; considers the first decision of 11 January 2011, taken by the Chairman of the Agency Management Board, to authorise the new activities of the former Executive Director of the Agency to be a breach of Union rules relating to conflicts of interest, in particular with regard to Title II, Article 16, of the Staff Regulations of the Officials of the European Communities; recalls that according to Title II, Article 11, and title IV, Article 91, of the Conditions of Employment of Other Servants of the European Communities, this provision applies by analogy to temporary agents and to contract employees; considers the fact that the Management Board adopted limitations on the future activities of the former Executive Director on 17 March 2011 - only after strong public protest - to be clear proof that the Agency did initially not apply the Staff Regulations properly, which in turn raises serious questions about their application of the rules in general; asks the Executive Director to present a detailed report on the implementation of Article 16 of the Staff Regulations within the Agency;

Article 4(5) provides that ‘without prejudice to national and Community law, including collective agreements between social partners, competent authorities may require the selected public service operator to grant staff previously taken on to provide services the rights to which they would have been entitled if there had been a transfer within the meaning of Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses (19).

1. Member States shall deploy appropriate staff in sufficient numbers to carry out the tasks relating to the examining of applications, in such a way as to ensure reasonable and harmonised quality of service to the public.

However, the Commission recalls that the Government Commissioner is present at every meeting of the Executive Committee, and can refer a matter to the Belgian authorities in order to revoke a decision made by the Management Board relating to a matter which is not concerned with the fulfilment of public service assignments if that decision is prejudicial to [.] the implementation of public service duties.
Cependant, la Commission rappelle que le commissaire du gouvernement est présent lors de chaque réunion du Comité d'Administration, et peut saisir les autorités belges par recours aux fins d'annuler une décision du conseil d'administration portant sur un sujet étranger à l’accomplissement des missions de service public si cette décision «porte [.] préjudice à la mise en œuvre des tâches de service public».

The Government Commissioner can call upon the Belgian authorities in order to revoke a decision of the Management Board relating to any matter not connected to the fulfilment of public service assignments if that decision ‘is prejudicial to [.] the implementation of public service duties’ (Article 23, paragraph 2, of the Act).
Le Commissaire du Gouvernement peut saisir les autorités belges aux fins d’annuler une décision du conseil d’administration portant sur un sujet étranger à l’accomplissement des missions de service public si cette décision «porte [.] préjudice à la mise en œuvre des tâches de service public» (article 23, alinéa 2 de la loi).

The legal basis for the initiative is Article 44 of the Staff Regulations applicable to Europol employees, pursuant to which the Europol Management Board carries out an annual review of the remuneration of Europol staff on the basis of changes in the cost of living in The Hague, taking particular account of any changes in salaries in the public service in the Member States and Europol recruitment needs .
