If a Party conditions the granting of a licence to supply public telecommunications services to a person of the Party in which a person of the other Party holds an equity interest on a finding that the supply of such services would serve the public interest, the Party shall ensure that it: (i) bases any such finding and the procedures for making such a finding on objective and transparent criteria; (ii) employs a presumption in favor of finding that granting a licence to a person of the Party in which a person of the other Party holds an equity interest would serve the public interest; and (iii) develops any such procedures consistent with Article 7.22 (Transparency and Confidential Information), Article 7.23 (Domestic Regulation) and Article 7.36 (Resolution of Telecommunications Disputes).

Calls on the Legislator to clarify the distinction between services of general interest and services of general economic interest; notes that for many services of general interest, the "economic/non-economic" distinction is extremely difficult, because - due to the dynamic character of these services - its borderline is rapidly evolving; proposes in that connection that the following criteria could be used to distinguish between economic and non-economic services : purpose of provision and supply (commercial or non-commercial); percentage of public-sector funding; level of investment; profit-motive, as distinct from covering costs; benefits as between local supply provision and a Europe-wide tendering requirement; commitment to guaranteeing social rights; furtherance of social inclusion and integration; these criteria can also be used to set up exemptions to the general competition rules in the case of economic services of general interest; .

The notions which are not common, but specific to the systems of one or a minority of Member States will have to be characterised by taking into account the following criteria: (i) the public interest objectives motivating the measure; (ii) whether the measure is linked to the invoked public interest objective; (iii) how efficient is the measure in achieving the invoked public interests objectives; (iv) whether the measure is characterised by cultural or social peculiarities.
