TRADUCTIONS EN CONTEXTE

This Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union in order to allow for the timely adoption of the revised financial rules of the PPP bodies in view of their entry into force as of 1 January 2016, and thus to ensure the effective application of the new external audit requirements to the audits of the annual accounts of the PPP bodies for 2016,

Environmental organisations are thus given a general right to contest and monitor the application of the law. That amounts to nothing more and nothing less than a system change in the implementation and control of the law as it stands in most of Europe’s Member States, with private bodies, in their guise as representatives of the public, being given the right to supervise the authorities.

Since the concept of 'public bodies' is not defined, it would appear to overlap with that of 'bodies governed by public law' (which fall within the subjective scope of the Directive, in accordance with a substantive concept of public administration), with the result that the Directive would allow for the possibility of bodies governed by public law having an entrepreneurial role and thus make it more difficult to define them (while strengthening what was previously, in the absence of corresponding legislation, a minority interpretation)
