While some technical difficulties may arise, it is felt that the use of statistics in the allocation of funds would have the positive effect of increasing the attention paid at national level to the correct and timely provision of data The proposed use of these statistics in the allocation of the funds for the period 2007-2013 is feasible, in particular because the forthcoming legislation on migration statistics is expected to result in better availability and harmonisation of statistics.

Therefore, in carrying out methodological visits to a Member State whose statistical information is under scrutiny, the Commission (Eurostat) should be entitled to have access to the accounts of government entities at central, state, local and social security levels, including the provision of underlying detailed accounting information, relevant statistical surveys and questionnaires and further related information, respecting the legislation on data protection as well as statistical confidentiality.

Member States shall provide the Commission (Eurostat), as promptly as possible, with the relevant statistical information requested for the needs of the data quality assessment, without prejudice to the provisions of Regulation (EC) No 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics relating to statistical confidentiality.

In particular, the Commission should be empowered to adapt the list of customs procedures or customs-approved treatment or use which determine an export or import for external trade statistics; to adopt different or specific rules for goods or movements which, for methodological reasons, call for specific provisions; to adapt the list of goods and movements excluded from external trade statistics; to specify the data sources other than the customs declaration for records on imports and exports of specific goods or movements; to specify the statistical data, including the codes to be used; to establish requirements for data related to specific goods or movements; to establish requirements on the compilation of statistics; to specify the characteristics of samples; to establish the reporting period and the level of aggregation for partner countries, goods and currencies; and also to adapt the deadline for transmitting statistics, content, coverage and revision conditions for statistics already transmitted; and to establish the deadline for transmitting statistics on trade by business characteristics and statistics on trade broken down by invoicing currency.

(21) Whereas the possible use of statistical information for the execution of the tasks to be carried out through the ESCB in accordance with Article 105 of the Treaty, while reducing the overall reporting burden, implies that the confidentiality regime defined in this Regulation must differ to some extent from the general Community and international principles on statistical confidentiality, and in particular from the provisions on statistical confidentiality in Council Regulation (EC) No 322/97 of 17 February 1997 on Community Statistics (7); whereas, subject to this point, the ECB will take into account the principles underlying Community statistics set out in Article 10 of Regulation (EC) No 322/97;

2. The Commission may adopt supplementary provisions, in accordance with the procedure laid down in Article 21, to maintain the scope of the provisions referred to in paragraph 1, taking account of changes in Community customs legislation and of provisions deriving from international conventions concluded by the Community and its Member States which affect statistics or which have an impact on statistical matters.

La Commission peut arrêter des dispositions complémentaires, selon la procédure prévue à l'article 21, en vue de maintenir la portée des dispositions visées au paragraphe 1, en tenant compte de l'évolution de la réglementation douanière communautaire et des dispositions résultant de conventions internationales conclues par la Communauté et ses États membres qui ont trait aux statistiques ou qui ont une incidence en matière statistique.

Whereas Council Directive 73/132/EEC of 15 May 1973 on the statistical surveys to be carried out by the Member States on bovine livestock, on forecasts of the availability of bovine animals for slaughter and on statistics on slaughtered bovine animals(3) and Council Directive 78/53/EEC of 19 December 1977 laying down additional provisions relating to the statistical surveys to be carried out by the Member States on bovine livestock(4) have been amended several times; whereas, furhter amendments being necessary, the provisions thereof should, for reasons of clarity, be recast;
considérant que la directive 73/132/CEE du Conseil, du 15 mai 1973, concernant les enquêtes statistiques sur le cheptel bovin, les prévisions sur la disponibilité en bovins de boucherie et les statistiques d'abattage de bovins, à effectuer par les États membres(3) et la directive 78/53/CEE du Conseil, du 19 décembre 1977, fixant des dispositions complémentaires concernant les enquêtes statistiques à effectuer par les États membres sur le cheptel bovin(4) ont été modifiées à plusieurs reprises; que, à l'occasion de nouvelles modifications, il convient, dans un souci de clarté, de procéder à une refonte de leurs dispositions;
