IN-CONTEXT TRANSLATIONS

In accordance with Article 10(1)(c) of Regulation (EU) No 1151/2012 the opponent alleged that the registration of ‘Liliputas’ as a Protected Geographical Indication would jeopardise the existence of a partly identical name, of trade marks and of products which have been legally on the Polish market for significantly more than five years preceding the date the application for registration of the name ‘Liliputas’ as Protected Geographical Indication was published in the Official Journal of the European Union (15 June 2013); according to the opponent, that registration would be a threat to the existence of the product named ‘Liliput’, which is a Polish cheese having characteristics similar to ‘Liliputas’ cheese and whose name is phonetically similar to the name ‘Liliputas’.
Conformément à l'article 10, paragraphe 1, point c), du règlement (UE) no 1151/2012, la partie à l'origine de l'opposition a fait valoir que l'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée compromettrait l'existence d'une dénomination partiellement homonyme, de marques et de produits qui ont été mis sur le marché polonais en toute légalité bien plus de cinq ans avant la date de publication au Journal officiel de l'Union européenne (15 juin 2013) de la demande d'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée. Selon cette même partie, cet enregistrement compromettrait l'existence du produit dénommé «Liliput», un fromage polonais présentant des caractéristiques similaires au fromage «Liliputas» et dont le nom est phonétiquement semblable au nom «Liliputas».

Therefore, the registration of the name ‘Liliputas’ as Protected Geographical Indication would prevent the Polish producers from marketing their ‘Liliput’ cheese or, in any event, from using the name ‘Liliput’ for a cheese.
L'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée empêcherait les fabricants polonais de commercialiser leur fromage «Liliput» ou, en tout état de cause, d'utiliser le terme «Liliput» pour désigner un fromage.

In the opinion of the opponent, the registration of the name ‘Liliputas’ as a Protected Geographical Indication would be a threat to the existence of such trade marks.

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission as regards laying down rules on the form of the product specification; laying down detailed rules on the form and content of the register of protected designations of origin and protected geographical indications; defining the technical characteristics of the Union symbols and indications as well as the rules on their use on products, including the appropriate linguistic versions to be used; granting and extending transitional periods for temporary derogations for use of protected designations of origin and protected geographical indication; laying down detailed rules on the form and content of the register of traditional specialities guaranteed; laying down rules for the protection of traditional specialities guaranteed; laying down all measures relating to forms, procedures and other technical details for the application of Title IV; laying down rules for the use of optional quality terms; laying down rules for the uniform protection of indications, abbreviations and symbols referring to the quality schemes; laying down detailed rules on the procedure, form and presentation of applications for registration and of oppositions; rejecting the application; deciding on the registration of a name if an agreement has not been reached; laying down detailed rules on the procedure, form and presentation of an amendment application; cancelling the registration of a protected designation of origin, a protected geographical indication or a traditional speciality guaranteed; and laying down detailed rules on the procedure and form of the cancellation process and on the presentation of the requests for cancellation.

4.8 Labelling: It is compulsory for the labelling to include the following: the wording ‘Butelo de Vinhais — Indicação Geográfica Protegida’ (Protected Geographical Indication) or ‘Bucho de Vinhais — Indicação Geográfica Protegida’ (Protected Geographical Indication) or ‘Chouriço de ossos de Vinhais — Indicação Geográfica Protegida’ (Protected Geographical Indication), the Community's own logo, the logo for Vinhais products reproduced below and the certification mark, which must indicate the name of the product, the designation/indication concerned, the control body and the serial number (numeric or alphanumeric code ensuring the product's traceability).
4.8. Étiquetage: L'étiquette doit obligatoirement comporter la mention «Butelo de Vinhais — Indicação Geográfica Protegida» ou «Bucho de Vinhais — Indicação Geográfica Protegida» ou «Chouriço de Vinhais — Indicação Geográfica Protegida», le logo européen correspondant et le logo des produits de Vinhais, dont le modèle est reproduit ci-après. Elle doit en outre porter la marque de certification, qui comprend obligatoirement le nom du produit et l'indication correspondante, le nom de l'organisme de contrôle et le numéro de série (code numérique ou alphanumérique qui permet la traçabilité du produit).
