As the relevant EU legislation requires prior assessment of the level of data protection guaranteed by third countries, the Commission stepped in to perform this function and negotiated PNR agreements with these countries.[67] It signed the US agreement in July 2007, the Australian one in June 2008 and an API/PNR agreement with Canada in October 2005.[68] The US and Australian agreements are provisionally applicable, while the Canadian one remains in force despite the expiry, in September 2009, of the Commission’s adequacy decision concerning Canadian data protection standards.[69] Critical of their content, the European Parliament has called on the Commission to renegotiate all three agreements on the basis of a clear set of principles.[70] Sent well in advance of a flight’s departure, PNR data help law enforcement authorities screen passengers for potential links to terrorism and other forms of serious crime.
