In order for the unthinkable to occur, that is, the ICC were to nullify a Canadian investigation or the prosecution of a war crimes case, the following process would have to have been followed: First, the prosecutor must decide that there is a reasonable basis to question that Canada has deliberately and fraudulently misinvestigated or misprosecuted allegations with the aim of shielding a suspected war criminal; second, the prosecutor must consult with the Canadian government regarding his suspicions and try to arrive at a negotiated resolution of the discrepancy; and third, the prosecutor must convince a pretrial chamber of the ICC that the case is valid.
