(13) The power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission to update the definitions laid down in this Decision in the light of changes to definitions adopted by the bodies of the UNFCCC or the Kyoto Protocol or other multilateral agreements relevant to climate change concluded by the Union, to amend Annex I to add accounting periods and ensure consistency between those accounting periods and the relevant periods adopted by the bodies of the UNFCCC, or other multilateral agreement relevant to climate change concluded by the Union, to amend Annex II with updated reference levels in accordance with the proposed reference levels submitted by Member States subject to corrections made in accordance with this Decision and in the light of changes to reference levels approved by the bodies of the UNFCCC or the Kyoto Protocol, to revise the information specified in Annex III in accordance with scientific progress and in the light of changes adopted by the bodies of the UNFCCC or the Kyoto Protocol or other successor frameworks and to revise the conditions relating to the accounting rules for natural disturbances laid down in this Decision in the light of scientific progress or to reflect revisions to acts adopted by the UNFCCC or Kyoto Protocol bodies.

The subject matter of the proposed Council decision is the conclusion of a Multilateral Agreement on the establishment of a European Common Aviation Area (ECAA).The ECAA would include all European Community member states; Iceland and Norway as members of the European Economic Area; and Albania, Bosnia-Herzegovina, Bulgaria, Croatia, the Former Yugoslav Republic of Macedonia (FYRM), Romania, Serbia and Montenegro and the United Nations Interim Administration Mission in Kosovo (UNMIK).

In this context, Article 27 of the proposal, on Relationship to agreements with third States, adds more uncertainty, stating that the Framework Decision is without prejudice to obligations and commitments incumbent upon Member States or upon EU by virtue of bilateral and/or multilateral agreements with third States.

6. Where parts of projects of common interest are situated within the territory of third countries, the Commission may, in agreement with the Member States concerned, put forward proposals, where appropriate within the framework of the management of the agreements between the Community and those third countries and in accordance with the Energy Charter Treaty and other multilateral agreements with third countries which are parties to that Treaty, for the projects also to be recognised as being of mutual interest by the third countries concerned, in order to facilitate their implementation.

Acting by a qualified majority on a proposal from the Commission, the Council may acknowledge equivalence between the conditions or provisions for type-approval of vehicles, systems, separate technical units and components established by this Directive together with the separate directives, and the procedures established by international regulations or regulations of third countries in the framework of multilateral agreements or bilateral agreements between the Community and third countries.
Le Conseil, statuant à la majorité qualifiée sur proposition de la Commission, peut reconnaître l'équivalence entre, d'une part, les conditions ou les dispositions relatives à la réception de véhicules, de systèmes, d'entités techniques et de composants établies par la présente directive et les directives particulières et, d'autre part, les procédures établies par des réglementations internationales ou des réglementations de pays tiers dans le cadre d'accords multilatéraux ou bilatéraux entre la Communauté et des pays tiers.

4. Asks the Commission therefore urgently to bring forward a proposal for a Regulation on flight and duty time limitations and rest requirements, with a view to maintaining high operational safety levels and the prevention of short-term crew fatigue; points out that such a regulation, together with the proposed Directive on working time, would be an indispensable instrument of the acquis communautaire in the context of a future multilateral agreement between the EU and other European countries on the establishment of a European Common Aviation Area and in the context of future enlargement;
4. demande donc instamment à la Commission de présenter une proposition de règlement sur les limitations de temps de service et de temps de vol et sur les exigences en matière de repos, en vue de maintenir un niveau élevé de sûreté d'exploitation et de prévenir la fatigue à court terme du personnel; indique qu'un tel règlement, de même que la proposition de directive sur le temps de travail, constituerait un instrument indispensable de l'"acquis communautaire” dans le contexte d'un accord multilatéral futur entre l'UE et d'autres pays européens sur la création d'un Espace européen aérien commun et dans la perspective de l'élargissement futur;

For this purpose, the Commission shall seek the implementation of international agreements applicable to UMTS, and shall, in particular and where necessary, submit proposals to the Council for appropriate mandates for the negotiation of bilateral and multilateral agreements with third countries and international organisations.
