On 12 October 2013, the federal government released Working Together for First Nation Students: A Proposal for a Bill on First Nation Education, which contained draft text of its proposed First Nations Education Act, for further input.35 The document’s release fulfilled the government’s commitment to share a draft of its proposed education legislation with First Nations.36 The proposed legislation would require that education services capable of leading to a recognized high school diploma be delivered by First Nations in one of three ways: by administering a school on reserve, by establishing a First Nation Education Authority, or through an agreement with a provincial school board.

If the group level resolution authority, after consultation with the other resolution authorities in accordance with paragraph 2, assesses that the failure of the institution in question, or the resolution action or other measures notified in accordance with point (b) of paragraph 1, would have a detrimental impact on the group or on affiliated institutions in other Member States, the group level resolution authority shall, no later than hours after receiving the notification under paragraph 1, propose a group resolution scheme and submit it to the resolution college.

If the group-level resolution authority, after consulting the other members of the resolution college, assesses that the resolution actions or other measures notified in accordance with point (b) of paragraph 1 of this Article, would make it likely that the conditions laid down in Article 32 or 33 would be satisfied in relation to a group entity in another Member State, the group-level resolution authority shall, no later than 24 hours after receiving the notification under paragraph 1, propose a group resolution scheme and submit it to the resolution college.

However, the Commission's proposal makes clear that this would be a body of elected members. It would be much larger than the present Consultative Council. It would have considerably extended powers and it would not be confined simply to regional policy or legislative proposals directly affecting the regions, but would cover any legislative proposals which would have an effect on regional and local authorities.
