In conclusion, the Court’s answer is that the prohibition on indirectly making available an economic resource, within the meaning of the regulation, encompasses acts relating to the supply and installation in Iran of a sintering furnace in working condition but not yet ready to use for the benefit of a third party which, acting on behalf, under the control or on the instructions of a person, an entity or a body listed in the annexes to that regulation, intends to use that furnace to manufacture, for the benefit of such a person, entity or body, goods capable of contributing to nuclear proliferation in that State.

3. It shall be prohibited to directly or indirectly make or be part of any arrangement to make new loans or credit with a maturity exceeding 30 days to any legal person, entity or body referred to in paragraph 1 or 2, after 12 September 2014 except for loans or credit that have a specific and documented objective to provide financing for non-prohibited direct or indirect imports or exports of goods and non-financial services between the Union and Russia or any other third State, or for loans that have a specific and documented objective to provide emergency funding to meet the solvency and liquidity criteria for legal persons established in the Union, whose proprietary rights are owned for more than 50 % by an entity referred to in Annex I.

“(N)ever, under any circumstances” can states parties directly or indirectly use, develop, produce, acquire, stockpile, retain or transfer cluster munitions to anyone.28 The prohibition on both direct and indirect actions reflects an intention to extend the prohibitions in the convention to cover a broad range of activity, and an attempt to prevent states parties from interpreting the treaty in a manner that allows them to avoid their obligations.29 Moreover, states parties must not encourage, induce or assist others to engage in such activities.30 In their relations with other states, states parties must encourage non-ratifying states to accept the convention, notify non-states parties of their obligations, promote the norms in the convention and make best efforts to discourage other states from using cluster munitions.31
