This Regulation respects the fundamental rights and observes the principles recognised by Articles 2 and 6 of the Treaty on European Union (TEU) and by the Charter, in particular respect for human dignity, the right to life, the prohibition of torture and of inhuman or degrading treatment or punishment, the prohibition of trafficking in human beings, the right to liberty and security, the right to the protection of personal data, the right to asylum and to protection against removal and expulsion, the principles of non-refoulement and non-discrimination, the right to an effective remedy and the rights of the child.

This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and notably human dignity, the prohibition of slavery, forced labour and trafficking in human beings, the prohibition of torture and inhuman or degrading treatment or punishment, the rights of the child, the right to liberty and security, freedom of expression and information, the protection of personal data, the right to an effective remedy and to a fair trial and the principles of the legality and proportionality of criminal offences and penalties.
La présente directive respecte les droits fondamentaux et observe les principes reconnus notamment par la charte des droits fondamentaux de l’Union européenne et en particulier la dignité humaine, l’interdiction de l’esclavage, du travail forcé et de la traite des êtres humains, l’interdiction de la torture et des peines ou traitements inhumains ou dégradants, les droits de l’enfant, le droit à la liberté et à la sûreté, la liberté d’expression et d’information, la protection des données à caractère personnel, le droit à un recours effectif et à accéder à un tribunal impartial, et les principes de légalité et de proportionnalité des délits et des peines.

Draws attention to its resolutions, as well as its oral questions with debates and its findings from missions in 2009 on concrete cases of fundamental rights, such as on privacy, personal dignity and data protection, on the prohibition of torture, on freedom of thought, conscience and religion, on freedom of expression and information, on freedom of the press and media, on non-discrimination, on the use of minority languages, on the situation of the Roma and on free movement, on Roma women, on discrimination against same sex marriages and civil-partnership couples, on minors, on retention centres for immigrants, and on the alleged illegal detention of prisoners under the CIA rendition programme; stresses that all these resolutions reflect the values enshrined in the Charter, show its clear commitment to the everyday protection of fundamental rights, and send political messages to all individuals in the EU, the Member States and the EU institutions as well as international partners;
attire l'attention sur ses résolutions et sur ses questions orales avec débat, ainsi que sur ses rapports de missions de 2009, concernant des cas concrets de droits fondamentaux tels que droit à la vie privée, dignité de la personne et protection des données, interdiction de la torture, liberté de pensée, de conscience et de religion, liberté d'expression et d'information, liberté de la presse et des médias, non-discrimination et utilisation des langues minoritaires, situation des Roms et liberté de circulation, situation des femmes Roms, discriminations à l'encontre des mariages homosexuels et des couples ayant conclu un partenariat civil, situation des mineurs, centres de rétention de migrants et allégations de détention illégale de prisonniers dans le cadre du programme de «transfert» de la CIA; souligne que toutes ces résolutions reflètent les valeurs consacrées par la Charte, illustrent l'engagement clair du Parlement à l'égard de la protection quotidienne des droits fondamentaux et adresse un message politique à tous les individus vivant dans l'Union européenne, aux États membres et aux institutions de l'UE, ainsi qu'aux partenaires internationaux;

(33) Whereas data which are capable by their nature of infringing fundamental freedoms or privacy should not be processed unless the data subject gives his explicit consent; whereas, however, derogations from this prohibition must be explicitly provided for in respect of specific needs, in particular where the processing of these data is carried out for certain health-related purposes by persons subject to a legal obligation of professional secrecy or in the course of legitimate activities by certain associations or foundations the purpose of which is to permit the exercise of fundamental freedoms;
(33) considérant que les données qui sont susceptibles par leur nature de porter atteinte aux libertés fondamentales ou à la vie privée ne devraient pas faire l'objet d'un traitement, sauf consentement explicite de la personne concernée; que, cependant, des dérogations à cette interdiction doivent être expressément prévues pour répondre à des besoins spécifiques, en particulier lorsque le traitement de ces données est mis en oeuvre à certaines fins relatives à la santé par des personnes soumises à une obligation de secret professionnel ou pour la réalisation d'activités légitimes par certaines associations ou fondations dont l'objet est de permettre l'exercice de libertés fondamentales;
