The CFP has a counter-productive approach to discards - on the one hand, the TAC rules require the discarding of vast quantities of commercial fish, both juvenile and mature. On the other hand, the only attempts to reduce this waste rely on micro-managing fishing gear and practices, which is almost guaranteed to provoke the industry into finding ways to subvert those regulations.

Recalls that on 14 December 2001 the Council adopted a resolution stating that the consumption of fruit and vegetables is an effective way of promoting public health, as demonstrated by the Commission's DG SANCO in a document dating from 2002; notes that this position was officially bolstered by the Global Plan of Action for Nutrition presented by the WHO; therefore suggests that general campaigns be financed by the Commission to encourage the consumption of fruit and vegetables produced in the EU (e.g. school projects), in view of the decrease in the consumption of fruit and vegetable products, which is worrying from the point of view of health factors; in addition calls for the introduction of a specific promotion mechanism that may be used to promote the consumption of products in connection with which production forecasts indicate the likelihood of a crisis arising as a result of a production surplus; also calls for advertising campaigns to take account of the latest scientific findings in the field of nutrition and, accordingly, to promote the consumption of unprocessed or lightly processed fruit and vegetables, with particular emphasis on organically grown products and on regional and local varieties of fruit and vegetables in order to strengthen biodiversity;

The Group of the European Peoples’ Party, however, has always believed that full compliance with this directive made it necessary for the rapporteur’s initial proposal to show a degree of flexibility, while allowing for certain exceptions since, although it is true that the majority of cosmetic products offer the consumer complete safety without their ingredients having to be tested on animals, there are certain cases in which scientists have still not been able to find reliable alternative methods for particular products which are not totally superfluous, such as sun products or creams, which provide a degree of protection from sunlight.
Cependant, le groupe du parti populaire européen a toujours pensé que l’application stricte de cette directive rendait nécessaire une certaine flexibilisation de la proposition initiale du rapporteur, afin d’admettre des exceptions bien précises puisque, s’il est vrai que la majorité des produits cosmétiques offrent une sécurité absolue au consommateur sans que leurs ingrédients ne doivent être testés sur des animaux, il existe des cas précis où les scientifiques n’ont pas encore pu obtenir de méthodes alternatives fiables pour certains produits qui ne sont absolument pas superflus, comme les produits solaires ou les crèmes pouvant générer une certaine photosensibilité.

2. Where the national authorities responsible for monitoring the market find that the product in question does not comply with the Community or national rules in force on product safety, they shall take appropriate action which may, if necessary, include prohibiting the product from being placed on the market in accordance with the said rules; in cases where placing on the market is prohibited, they shall ask the customs authorities to include one of the following endorsements on the commercial invoice accompanying the product and on any other relevant accompanying document:
