2. If, nevertheless, such a derogation or restrictive clause is applied in respect of a passenger, or if the passenger is not correctly informed of his rights and for that reason has accepted compensation which is inferior to that provided for in this Regulation, the passenger shall still be entitled to take the necessary proceedings before the competent courts or bodies in order to obtain additional compensation.

Each Member State shall ensure that victims of criminal acts are entitled to obtain a decision within reasonable time limits on compensation by the offender in the course of criminal proceedings, except where, in certain cases, national law provides for compensation to be awarded in another manner.

(28) The compensation body should have a right of subrogation in so far as it has compensated the injured party; in order to facilitate enforcing the compensation body's claim against the insurance undertaking where it has failed to appoint a claims representative or is manifestly dilatory in settling a claim, the body providing compensation in the injured party's State should enjoy an automatic right of reimbursement with subrogation to the rights of the injured party on the part of the corresponding body in the State where the insurance undertaking is established; the latter body is the best placed to institute proceedings for recourse against the insurance undertaking.

Afin de faciliter la poursuite de son action à l'encontre de l'entreprise d'assurance qui n'a pas désigné de représentant ou qui retarde manifestement le règlement, il convient que l'organisme d'indemnisation du pays de la personne lésée jouisse d'un droit de remboursement automatique avec subrogation de l'organisme d'indemnisation de l'État où l'entreprise d'assurance est établie dans les droits de la personne lésée. Ce dernier organisme est le mieux placé pour engager une action récursoire contre l'entreprise d'assurance.
