whereas Article 45(2) of the SRM Regulation provides that the Board should submit an annual report to, inter alia, Parliament, on the performance of the tasks conferred on the Board by that Regulation; whereas that report should in particular cover Board activities as regards resolution planning, assessments of resolvability, determinations of minimum requirements for own funds and eligible liabilities, resolution actions, and the exercise of other duties and powers under the SRM Regulation; whereas that report should also cover detailed information regarding the Single Resolution Fund (the Fund), in particular the evolution of the available financial means of the Fund and any decisions concerning the period for reaching the target level and the calculation of contributions in accordance with Articles 69 to 71 of the SRM Regulation; borrowing, lending and other financial arrangements in accordance with Articles 72 to 74 of the SRM Regulation; the administration and investment strategy of the Fund, in accordance with Article 75 of the SRM Regulation and the applicable Commission delegated acts; the specific conditions of use of the Fund for an individual resolution scheme in accordance with Articles 76 to 78 of the SRM Regulation; the application of the principles of division into national compartments and of progressive merger during the transitional period provided for in Article 3(1)(37) of the SRM Regulation, in accordance with Article 77 of the SRM Regulation, and the use of deposit guarantee schemes in accordance with Article 79 of the SRM Regulation;
considérant que l'article 45, paragraphe 2, du règlement relatif au MRU prévoit la présentation par le CRU d'un rapport annuel, notamment au Parlement, sur l'accomplissement des tâches que lui confère ce règlement; que ce rapport devrait traiter en particulier des activités du CRU en matière de planification de la résolution, d'évaluation de la résolvabilité, de détermination des exigences minimales de fonds propres et d'engagements éligibles, de mesures de résolution ainsi que d'exercice des autres pouvoirs et de réalisation d'autres missions que lui confère le règlement relatif au MRU; qu'il y a lieu que ce rapport propose également des informations détaillées sur le Fonds de résolution unique (ci-après dénommé «Fonds»), notamment sur l'évolution des moyens financiers disponibles du Fonds et sur toute décision concernant le calendrier prévu pour atteindre le niveau cible et le calcul des contributions, conformément aux articles 69 à 71 du règlement relatif au MRU; les emprunts, prêts et autres arrangements financiers, conformément aux articles 72 à 74 du règlement relatif au MRU; la stratégie d'administration et d'investissement du Fonds, conformément à l'article 75 du règlement relatif au MRU et aux actes délégués de la Commission y afférents; les conditions particulières d'utilisation du Fonds pour un plan individuel de résolution, conformément aux articles 76 à 78 du règlement relatif au MRU; l'application des principes de division en compartiments nationaux et de fusion progressive pendant la période de transition prévue à l'article 3, paragraphe 1, point 37), du règlement relatif au MRU, conformément à l'article 77 dudit règlement, et l'utilisation du système de garantie des dépôts conformément à l'article 79 dudit règlement;

whereas the Commission will take due account of the respective roles conferred by the Treaties on Parliament and the Council, in particular with reference to the basic principle of equal treatment laid down under point 9,

P. whereas Parliament has continued to receive petitions alleging persistent breaches by Member States of the petitioners' human and fundamental rights, whereas under Article 6(1) of the EU Treaty the Union is founded on the principles of liberty, democracy, respect for human rights and fundamental freedoms, and the rule of law, and whereas Article 7(1) of the EU Treaty gives Parliament the right to initiate a procedure to determine whether there is a clear risk of a serious breach by a Member State of principles mentioned in Article 6(1),

whereas a Declaration of Principles for International Election Observation and a Code of Conduct for International Elections Observers were adopted under the auspices of the UN in 2005, and have been endorsed by both the Commission and Parliament, as well as by 32 other international governmental and non-governmental organisations,
considérant qu'une déclaration de principes relative à l'observation internationale d'élections et un code de conduite à l'usage des observateurs électoraux internationaux ont été adoptés sous l'égide des Nations unies en 2005, et ont été approuvés tant par la Commission que par le Parlement, de même que par 32 autres organisations internationales gouvernementales et non gouvernementales,

Whereas the information exchanged may concern physical persons and this Regulation must therefore implement, in its scope, the principles of protection of persons with regard to processing, by automatic means or otherwise, of personal data; whereas these principles, as set out in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (8) should themselves, in compliance with the terms and conditions of this Directive, be specified and supplemented in this Regulation; whereas pending implementation of the national measures transposing that Directive certain Member States which have no protection rules for personal data exchanged by non-automatic means should be exempted from applying the provisions of this Regulation concerning the non-automatic exchange of data;
considérant que les informations échangées peuvent concerner des personnes physiques et que le présent règlement doit donc mettre en oeuvre dans son champ d'application les principes de la protection des personnes à l'égard du traitement, automatisé ou non, de leurs données à caractère personnel; que les principes, tels qu'ils figurent dans la directive 95/46/CE du Parlement européen et du Conseil, du 24 octobre 1995, relative à la protection des personnes physiques à l'égard du traitement des données à caractère personnel et à la libre circulation de ces données (8), doivent être eux-mêmes, dans les termes et conditions de cette directive, précisés et complétés dans le présent règlement; que, en attendant l'application des mesures nationales transposant cette directive, il convient de dispenser de l'application des dispositions du présent règlement relatives aux échanges de données non automatisées certains États membres qui, au stade actuel, ne disposent pas de règles de protection à l'égard de telles données;
