The protection of the safety and health of pregnant workers, workers who have recently given birth or workers who are breastfeeding should be guaranteed and not run counter to the principles enshrined in the Directives concerning equal treatment for men and women.

These are: maximum work periods and minimum rest periods, minimum paid annual holidays, minimum rates of pay, including overtime rates, the conditions of hiring out of workers, in particular the protection of workers hired out by temporary employment undertakings, health, safety and hygiene at work, protective measures with regard to the terms and conditions of employment of pregnant women or women who have recently given birth and of children and young people and equality of treatment between men and women and other provisions on non-discrimination.

The entire period of on-call time, including the inactive part, shall be regarded as working time. However, Member States shall have the option, subject to compliance with the general principles relating to the protection of the safety and health of workers, and provided that the social partners concerned have been consulted, of allowing, by means of laws, regulations or collective agreements or agreements between the two sides of industry, inactive on-call periods to be counted in a specific manner for the purpose of calculating the average maximum weekly working time provided for in Article 6, provided that the workers concerned are afforded adequate compensatory rest, and provided that pregnant women and parents of children under the age of one are exempt from such measures, if they so request, or are afforded appropriate protection.

2. Member States shall provide necessary medical or other assistance to the third-country nationals concerned, who do not have sufficient resources and have special needs, such as pregnant women, the disabled or victims of sexual violence or other forms of violence and, if Member States have recourse to the option provided for in Article 3(3), minors.

3. Member States shall provide, under the same eligibility conditions as nationals of the Member State that has granted the status, adequate health care to beneficiaries of refugee or subsidiary protection status who have special needs, such as pregnant women, disabled people, persons who have undergone torture, rape or other serious forms of psychological, physical or sexual violence or minors who have been victims of any form of abuse, neglect, exploitation, torture, cruel, inhuman and degrading treatment or who have suffered from armed conflict.
3. This Directive is therefore without prejudice to Council Directive 92/85/EEC of 19 October 1992 on the introduction of measures to encourage improvements in the safety and health at work of pregnant workers and workers who have recently given birth or are breastfeeding(9) (tenth individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC), which aims to ensure the protection of the physical and mental state of women who are pregnant, women who have recently given birth or women who are breastfeeding.

The Council must not leave various specific proposals that have been postponed year after year simply hanging in the air. I have in mind proposals on decisions that are crucial to improving the rights of working women who are pregnant or breastfeeding, and vital for improving workers’ collective and individual rights, including the right to information, consultation and participation, specifically in the framework of the European Company Statute and of the European Works Council. This is necessary from the point of view of guaranteeing workers’ rights and preventing redundancies as a result of successive mergers and relocations by multinationals in various European countries.
