IN-CONTEXT TRANSLATIONS

(a) the prevailing interest rate in the territory of the government that made the preferential loan, at the date the preferential loan was made, in respect of non-guaranteed commercial loans that the recipient of the preferential loan could have obtained, in the same currency in which the payments for the preferential loan are expressed and on credit terms, other than the interest rate, that are the same or substantially the same as the credit terms of the preferential loan;

(4) If “J” is set out in the column entitled “Preferential Tariff” in the List of Tariff Provisions following the abbreviation “GPT” in relation to goods entitled to the General Preferential Tariff, the General Preferential Tariff rate of customs duty that applies to those goods is the initial rate, reduced by one percentage point on January 1 of each year after 1998, until the difference between the reduced rate and the final rate is less than one percentage point, at which time the final rate applies.

(49) In order to ensure uniform conditions for the implementation of this Regulation as regards exports and certain general provisions, implementing powers should also be conferred on the Commission in respect of measures on the treatment of refund certificates by the Member States and the exchange of information and the specific administrative assistance between the Member States as regards the refund certificates, measures on the fixing of the global amount allocated to small exporters and the individual threshold of exemption from the presentation of refund certificates, measures on the issuing of replacement refund certificates and duplicate refund certificates, measures limiting the amounts for which refund certificates may be issued, rejecting amounts applied for in respect of those certificates and suspending the lodging of applications for refund certificates where amounts that exceed available amounts fixed on the basis of the commitments resulting from international agreements, are applied for, necessary procedural rules and technical criteria for the application of other measures with regard of exports, measures on fixing the applicable duty in case of direct offsetting in preferential trade and the related amounts payable on exports to the country or region concerned, measures ensuring that processed agricultural products declared for export under a preferential trade agreement are not in fact exported under a non- preferential agreement or vice versa , measures concerning the methods of qualitative and quantitative analysis of processed agricultural products and non-Annex I goods, the technical provisions necessary for their identification and the procedures for the purpose of their classification in the Combined Nomenclature.
(49) Afin d'assurer des conditions uniformes d'exécution du présent règlement en ce qui concerne les exportations et certaines dispositions générales, il convient de conférer des compétences d'exécution à la Commission en vue d'adopter des mesures sur le traitement des certificats de restitution à l'exportation par les États membres et l'échange d'informations et l'assistance administrative spécifique entre les États membres, des mesures concernant la fixation du montant global alloué aux petits exportateurs et le seuil d'exemption individuel pour la présentation de certificats de restitution, des mesures sur la délivrance de certificats de restitution de remplacement et de duplicatas de certificats de restitution, des mesures limitant le montant pour lequel des certificats de restitution peuvent être délivrés, rejetant des montants demandés pour ces certificats et suspendant l'introduction de demandes de certificats de restitution lorsque des montants supérieurs aux montants disponibles fixés sur la base des engagements résultant des accords internationaux conclus sont demandés, les règles procédurales et les critères techniques nécessaires à l'application d'autres mesures concernant les exportations, des mesures fixant le droit applicable en cas de compensation directe dans les échanges préférentiels et les montants liés à payer sur les exportations vers le pays ou la région concerné, des mesures assurant que les produits agricoles transformés déclarés pour exportation au titre d'un accord commercial préférentiel ne sont pas exportés au titre d'un accord non-préférentiel ou vice-versa , des mesures concernant les méthodes d'analyse qualitative et quantitative des produits agricoles transformés et des marchandises hors annexe I, les dispositions techniques nécessaires pour leur identification et les procédures à appliquer aux fins de leur classification, dans la Nomenclature combinée.

L. whereas, in lack of an effective EU control mechanism, Israeli settlement products continue to arrive on the European market under preferential treatment; whereas the European Parliament, in its resolution on the proposal for a Council decision on the conclusion of the regional Convention on pan-Euro-Mediterranean preferential rules of origin of 16 February 2012, expressed its serious concern about the practices employed by certain companies in exploiting the terms of the EU-Israel Association Agreement by exporting goods produced in the occupied Palestinian Territory to the European market under preferential treatment, noted that the solutions offered by the relating technical arrangement between the EU and Israel were not satisfactory in this regard, considered that a simple, efficient and reliable mechanism to replace this arrangement should be agreed with Israel, urged however Member States to ensure that their customs authorities effectively apply the existing technical arrangement, and invited the Commission to put forward new proposals and to work together with the European Parliament to find a solution to this abuse of preferential access to the Union’s internal market;
L. considérant qu'en l'absence de mécanisme de contrôle efficace de l'Union européenne, les produits issus des colonies israéliennes continuent d'arriver sur le marché européen en bénéficiant d'un traitement préférentiel; considérant que le Parlement européen, dans sa résolution du 16 février 2012 sur la proposition de décision du Conseil relative à la conclusion de la convention régionale sur les règles d'origine préférentielles paneuroméditerranéennes, s'inquiète vivement des pratiques utilisées par certaines entreprises qui persistent à tirer profit des dispositions de l'accord d'association UE-Israël en exportant des biens produits dans les territoires occupés, note que les solutions apportées par les arrangements techniques en la matière en l'Union et Israël ne sont pas satisfaisantes à cet égard, estime qu'il conviendrait de s'accorder avec Israël pour remplacer cet arrangement par un mécanisme simple, efficace et fiable, invite toutefois instamment les États membres à s'assurer que leurs autorités douanières appliquent effectivement l'arrangement technique existant, et invite la Commission à présenter de nouvelles propositions et à coopérer avec le Parlement européen pour trouver une solution à cet abus de l'accès préférentiel au marché intérieur de l'Union;

N. whereas it is the customs authorities of the individual EU Member States which are responsible for checking the validity of claims regarding the preferential origin of products imported into the EU; whereas the customs authorities, despite their best endeavours, cannot possibly check and control each and every proof-of-origin document and every consignment preferentially imported from Israel into the EU; whereas the Convention may compound this logistical challenge by expanding the number of partner countries that cumulate working or processing with materials exported by Israel when exporting products under their agreements with the EU;
N. considérant que ce sont les autorités douanières de chaque État membre qui ont pour responsabilité de vérifier la validité des demandes introduites au sujet de l'origine préférentielle des produits importés dans l'Union européenne; considérant que les autorités douanières, malgré tous leurs efforts, ne sont en mesure de vérifier et de contrôler ni toutes les preuves d'origine ni le contenu de tous les envois provenant d'Israël qui sont importés au titre du régime préférentiel dans l'Union; considérant que la convention pourrait alourdir ce défi logistique en augmentant le nombre de pays partenaires qui cumulent les ouvraisons ou les transformations réalisées avec des matières exportées par Israël, au moment de l'exportation de produits dans le cadre des accords conclus avec l'Union;
