With respect to workers temporarily posted to carry out work in order to provide services in another Member State than the one in which they habitually carry out their work, Directive 96/71/EC of the European Parliament and of the Council establishes a core set of clearly defined terms and conditions of employment which are required to be complied with by the service provider in the Member State to which the posting takes place to ensure the minimum protection of the posted workers concerned.
Concernant les travailleurs provisoirement détachés pour l'exécution de travaux liés à la prestation de services dans un autre État membre que celui dans lequel ils exercent habituellement leur activité, la directive 96/71/CE du Parlement européen et du Conseil établit un socle de conditions de travail et d'emploi clairement définies, garantissant une protection minimale de ces travailleurs, qui doivent être respectées par le prestataire de services dans l'État membre d'accueil.

(3) With respect to workers temporarily posted to carry out work in order to provide services in another Member State than the one in which they habitually carry out their work, Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996 concerning the posting of workers in the framework of the provision of services establishes a core set of clearly defined terms and conditions of work and employment which must be complied with by the service provider in the Member State to which the posting takes place to ensure the minimum protection of the posted workers concerned.
(3) Concernant les travailleurs provisoirement détachés pour l'exécution de travaux liés à la prestation de services dans un autre État membre que celui dans lequel ils exercent habituellement leur activité, la directive 96/71/CE du Parlement européen et du Conseil du 16 décembre 1996 concernant le détachement de travailleurs effectué dans le cadre d'une prestation de services établit un socle de conditions de travail et d'emploi clairement définies, garantissant une protection minimale de ces travailleurs, qui doivent être respectées par le prestataire de services dans l'État membre d'accueil.

Member States should therefore ensure that such information is made generally available, free of charge and that effective access to it is provided, not only to service providers from other Member States, but also to the posted workers concerned.

Those measures should be defined by national law, taking into account the specific circumstances of the Member State concerned, and they may include, inter alia, measures taken by the contractor concerning documentation of compliance with administrative requirements and control measures in order to ensure effective monitoring of compliance with the applicable rules on the posting of workers.

The lack of the certificate concerning the applicable social security legislation referred to in Regulation (EC) No 883/2004 of the European Parliament and of the Council may be an indication that the situation should not be characterised as one of temporarily posting to a Member State other than the one in which the worker concerned habitually works in the framework of the provision of services.
