Recalls that freedom of thought, conscience, religion and belief is a fundamental human right, as recognised in the Universal Declaration of Human Rights and guaranteed by Article 18 of the International Covenant on Civil and Political Rights; expresses its concern at the fact that some countries still fail to abide by UN standards and use state repression, which may include physical punishment, prison terms, exorbitant fines and even the death penalty, in violation of freedom of religion or belief; is concerned about the increased persecution of religious or belief minorities, including Christian communities, as well as unlawful damage to their assembly sites; supports the report of the UN Special Rapporteur on Freedom of Religion or Belief on violence committed ‘in the name of religion’; calls for the EU to implement its recommendations on interreligious dialogue initiatives;

The EU considers that the above convictions undermine the rights to freedom of expression and freedom of association and calls on Syria to abide by the international commitments it freely entered into, in particular under the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which guarantees freedom of opinion and of expression and the right to a fair trial.

Regrets China's postponement of the eleventh China-EU summit on the grounds of the Dalai Lama's visit to Europe; emphasises the need for a radical intensification and re-thinking of the European Union-China human rights dialogue; expresses its disquiet at the serious human rights violations in China and stresses that, despite promises made by the regime before the Olympic Games in August 2008, the situation on the ground regarding human rights has not improved; points out, moreover, that restrictions on freedom of association, expression and religion have been further tightened; strongly condemns the crackdown against Tibetans following the wave of protests that swept across Tibet beginning on 10 March 2008 and the repression by the Chinese government that has increased in Tibet since then, and calls for the restart of a sincere and results-oriented dialogue between both parties based on the "Memorandum on Genuine Autonomy for the Tibetan People"; notes that, despite repeated assurances by the Chinese government of its intention to ratify the International Covenant on Civil and Political Rights, ratification is still pending; refers to Parliament's resolution of 17 January 2008 on the arrest of the Chinese dissident Hu Jia , who has been awarded the 2008 Sakharov Prize for Freedom of Thought; calls on the Chinese government to release Hu Jia immediately and to lift the house arrest on his wife Zeng Jinyan and his daughter; condemns the wave of repression against signatories of the "Charter 08", a document calling for democratic reforms in China and demanding the release of Liu Xiaobo, a dissident who has been detained since 9 December 2008; expresses concern that the legal system remains vulnerable to arbitrary and often politically-motivated interference, including the State Secrets system, preventing the transparency necessary for the development of good governance and a system in which the rule of law prevails; in this context, deplores the systemat ...

She recommends that the government of Cuba take the following measures: halt the prosecution of citizens who are exercising their guaranteed rights under the Universal Declaration of Human Rights; release detained prisoners who have not committed acts of violence; review laws that lead to criminal prosecution of persons exercising their freedom of expression, demonstration, assembly, etc.; uphold, without exception, the moratorium in the application of the death penalty; reform the rules of criminal procedure to bring them into line with the requirements of the Universal Declaration; establish a standing independent body with the function of receiving complaints from persons complaining that their fundamental rights have been abridged; review the regulations relating to travel into and out of Cuba in order to guarantee freedom of movement as defined in the Universal Declaration; authorize non-governmental organizations to enter Cuba; foster pluralism with respect to associations, trade unions, organs of the press, and political parties; and finally, accede to the International Covenant on Civil and Political Rights and its optional protocols.
Dans ce rapport, Mme Chenet formule des recommandations et j'en résumerai quelques-unes. Elle recommande au gouvernement de Cuba de prendre les mesures suivantes : mettre fin aux poursuites intentées contre les citoyens ayant exercé des droits garantis par la Déclaration universelle des droits de l'homme; libérer les prisonniers qui n'ont pas commis d'actes violents; revoir les lois qui permettent d'intenter des poursuites criminelles contre des personnes ayant exercé leur liberté d'expression, d'association ou de participation à des manifestations, par exemple; respecter, sans exception, le moratoire sur l'application de la peine de mort; réformer les règles régissant les poursuites criminelles pour les rendre conformes aux principes de la Déclaration universelle; créer un organisme indépendant habilité à recevoir les plaintes de personnes qui estiment qu'on a bafoué leurs droits fondamentaux; revoir la réglementation qui s'applique aux voyages à destination et en provenance de Cuba afin de garantir la libre circulation aux termes de la Déclaration universelle; autoriser les organisations non gouvernementales à se rendre à Cuba; favoriser le pluralisme dans les associations, les syndicats, les médias et les partis politiques; et enfin, adhérer au Pacte international relatif aux droits civils et politiques de même qu'à ses protocoles facultatifs.

The EU calls on Iran to implement fully its international human rights obligations, notably those contained in the International Covenant on Civil and Political Rights, which provides that everyone shall have the right to freedom of expression, and the International Covenant on Economic, Social and Cultural Rights, which guarantees the right to form and join trade unions.

The right to freedom of expression is fundamental to democracy and a fundamental freedom laid down in the Universal Declaration on Human Rights, as well as in the International Covenant on Civil and Political Rights and African Charter on Human and People's Rights, to which the Democratic Republic of Congo is a State Party.
