Notwithstanding the provisions of paragraphs 1 and 2, income derived by a resident of a Contracting State from that person’s personal activities as an entertainer or as a sportsperson shall be taxable only in that State if the activities are wholly or mainly supported by public funds of one or both of the Contracting States or political subdivisions or local authorities thereof or the activities are exercised in the other Contracting State within the framework of a cultural or sports exchange programme approved by both Contracting States.

3. Notwithstanding the provisions of paragraphs 1 and 2 income derived by a resident of a Contracting State, who is an entertainer or sportsperson, from that person’s personal activities as such in the other Contracting State, shall be exempt from tax in the Contracting State in which these activities are exercised if the activities are exercised within the framework of a visit which is substantially supported by the other Contracting State, a political subdivision, a local authority or a public institution thereof.

Renews its call for the approach to an integrated maritime policy for the EU to be continued in future and calls on the Commission to strengthen the political framework thereof, as well as the territorial, social, and economic cohesion providing the link to inland Europe and its constituent policies; proposes that a report on European maritime policy be published every two years and that a regular public exchange of views be held with all those involved; calls on future Council presidencies to deal with maritime policy as part of their work programmes; over and above this, calls for all maritime-related projects supported by EU funding to be clearly identified annually by the Commission;

This Framework Decision respects fundamental rights and adheres to the principles recognised in Article 6 of the Treaty on European Union, which are also expressed in the Charter of Fundamental Rights of the European Union, especially in Chapter VI thereof. No provision of this Framework Decision should be interpreted as prohibiting refusal to recognise a judgment and/or supervise a probation measure or alternative sanction if there are objective reasons to believe that the probation measure or alternative sanction was imposed to punish a person because of his or her sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation or that this person might be disadvantaged for one of these reasons.
La présente décision-cadre respecte les droits fondamentaux et observe les principes reconnus par l’article 6 du traité sur l’Union européenne, qui sont également énoncés dans la Charte des droits fondamentaux de l’Union européenne, notamment dans son chapitre VI. (7) This Framework Decision is intended to respect fundamental rights and to observe the principles recognised by Article 6 of the Treaty and reflected by the Charter of Fundamental Rights of the European Union, in particular Chapter VI thereof. Nothing in this Framework Decision should be interpreted as prohibiting refusal to execute a decision when there are objective reasons to believe that the sentence was imposed for the purpose of punishing a person on the grounds of his or her sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation, or that that person's position may be prejudiced on anyone of those grounds.

2. Considers that a minimum degree of financial stability should be given to the European political parties and welcomes the proposal to provide a multiannual financial framework at the beginning of each parliamentary term with regard to both the basic amount per party (15% of the total budget) and the additional amount per MEP accounted for by the parties (85% of the total budget), thus allowing the existing political parties to undertake the long-term planning needed in respect of their political activities, programmes and personnel and in relation to the means necessary for the implementation thereof;

This Framework Decision respects fundamental rights and observes the principles recognised by Article 6 of the Treaty and reflected by the Charter of Fundamental Rights of the European Union, notably Chapter VI thereof. Nothing in this Framework Decision may be interpreted as prohibiting refusal to freeze property for which a freezing order has been issued when there are reasons to believe, on the basis of objective elements, that the freezing order is issued for the purpose of prosecuting or punishing a person on account of his or her sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation, or that that person's position may be prejudiced for any of these reasons.

Moreover, since the adoption of the Directive in 1986, the legal and political context has changed fundamentally as a result of the entry into force of the Single European Act, in particular Article 118A thereof, and the adoption in 1989 of the Directive 89/391/EEC, setting out a new framework for health and safety at work.
