By the Contested Decision the Commission found that the applicant had infringed Article 81 EC by participating in a complex of agreements and concerted practices in the plastic industrial bags sector, affecting Belgium, France, Germany, Luxembourg, the Netherlands and Spain, consisting in the fixing of prices and the establishment of common price calculation models, the sharing of markets and the allocation of sales quotas, the assignment of customers, deals and orders, the submission of concerted bids in response to certain invitations to tender and the exchange of individualised information.

The European Commission has fined 16 firms €290.71 million for operating a cartel in the plastic industrial bags market, in clear violation of EC Treaty rules which forbid cartels and other restrictive business practices (Article 81). In this instance competitors, with a view to increasing their profits, agreed amongst themselves on prices and sales quotas by geographical area, shared the orders of large customers, organised collusive bidding for invitations to tender and exchanged information on their sales volumes, to the detriment of competition, their customers and consumers.
La Commission européenne a infligé à 16 entreprises des amendes de €290,71 millions pour avoir mis en œuvre une entente illégale sur le marché des sacs industriels en plastique, en violation manifeste des règles du traité instituant la Communauté européenne qui interdisent les ententes et autres pratiques commerciales restrictives (article 81).Cette entente consistait à fixer entre concurrents les prix et les quotas de vente par zone géographique, à répartir les commandes des gros clients, à organiser des soumissions concertées à certains appels d’offre et à mettre en œuvre des mécanismes d’échange d’informations sur leurs volumes de vente, et ce au détriment de la concurrence, de leurs clients et des utilisateurs et en vue d’augmenter leurs profits.

YANTAI LONGQUAN PACKAGING MATERIAL CO., LTD, a company located in the PRC, whose exports to the Community of certain plastic sacks and bags are subject to an average anti-dumping duty for co-operating companies of 8,4 % by the above-mentioned Regulation, has informed the Commission that the company name changed on 21 July 2004 to YANTAI LONGQUAN PLASTIC AND RUBBER PRODUCTS CO., LTD. The change of Enterprise registration was approved by the ‘Administration of Industry and Commerce of Yantai City ’on 21 July 2004.
La société YANTAI LONGQUAN PACKAGING MATERIAL CO., LTD, implantée en RPC et dont les exportations, vers la Communauté, de certains sacs et sachets en matières plastiques sont soumises, en vertu du règlement précité, à un droit antidumping moyen de 8,4 % établi pour les sociétés ayant coopéré, a informé la Commission que son nom avait été changé, le 21 juillet 2004, en «YANTAI LONGQUAN PLASTIC AND RUBBER PRODUCTS CO., LTD». Le changement d'immatriculation de l'entreprise a été approuvé par l'Administration de l'industrie et du commerce de la ville de Yantai, le 21 juillet 2004.
