1. This Regulation lays down rules regarding phytosanitary inspections and other official measures by the Member State authorities for the purpose of identifying the phytosanitary risks posed by any species, strain or biotype of pathogenic agents, animals or plants injurious to plants or plant products (hereinafter ‘pests’), including invasive alien plant species which are injurious to plants and phytosanitary measures necessary to prevent the entry of pests from other Member States or third countries.

Again, whereas the Legal Service argues that legislative practice more often than not combines the two legal bases of Article 37 and Article 152(4)(b) and that it is often difficult to distinguish between purely agricultural (veterinary or phytosanitary measures) and agricultural measures aimed principally at protecting legal health, it concedes that the use of Article 37 for the adoption of such measures harks back to the pre-Amsterdam regime when there was no specific Treaty article on veterinary and phytosanitary measures and that in some cases the legislator has used Article 152(4)(b) alone as the legal basis for measures adopted to control a specific animal or plant disease constituting a specific danger to animal health.

Welcomes the Commission's intention to respect WTO commitments regarding sanitary and phytosanitary (SPS) measures, but considers that this should not preclude the possibility - specifically admissible under the WTO Agreement on the Application of Sanitary and Phytosanitary Measures - of introducing measures that lead to higher standards of protection where this is sufficiently scientifically justified; considers, in addition, that it is important to encourage the adoption of such measures at international level in order to ensure upward convergence;

Believes that cooperation in the promotion of regulatory convergence in the agricultural sector, notably with regard to sanitary and phytosanitary measures, should be intensified; stresses the importance, for many Member States, of exports of agricultural products to Russia, i.e. fish, meat and dairy products; expresses concern, therefore, at the recent restrictive measures adopted by Russia in this field and urges the EU to back the Member States affected by those measures and to find a common solution to problems with exports to the Russian market, specifically relating to sanitary and phytosanitary measures;
