It respects the substance of the proposal and it includes a budgetary allocation of EUR 230 million, which is worthy of a PHARE programme. This allocation is also in line with the budgetary programming prepared by the Commission with a view to enlargement.

Considers that the Tacis programme should facilitate significant investment in the same way as the Phare programme, as the significance of infrastructure projects is more marked in weakly developed regions; in order for resources to be used rationally and effectively in cross-border cooperation between the EU and third countries, it is necessary, inter alia, that the CBC sections of the Interreg II, Tacis and Phare programmes should be coordinated so as to ensure genuine project-centred cooperation and cooperation between citizens; Tacis-CBC should provide for multiannual projects to facilitate the consolidation of Interreg; considers it regrettable that Tacis programmes, in particular, are administered centrally in capitals; considers that adequate resources should be allocated to regional Tacis offices to enable the programmes which are carried out to take better account of aspects which are important to the regions; considers it important that the Commission should also have at its disposal adequate staff resources for the new duties relating to cross-border cooperation;
18. considère que le programme TACIS devrait, à la manière du programme PHARE, permettre des investissements conséquents, dans la mesure où l'importance des projets d'infrastructure est insuffisamment mise en avant dans les régions en développement; une utilisation judicieuse et efficace des ressources en matière de coopération transfrontalière entre l'UE et les pays tiers requiert, entre autres, une harmonisation des volets des programmes Interreg II, TACIS et PHARE relatifs à la coopération transfrontalière pour assurer une véritable coopération orientée vers les projets et une coopération entre les citoyens; la coopération transfrontalière dans le cadre de TACIS devrait permettre la réalisation de projets pluriannuels afin de faciliter la consolidation d'Interreg; estime qu'il est regrettable que les programmes dans le cadre de TACIS notamment soient administrés de façon centralisée au niveau des capitales; estime que des ressources suffisantes devraient être allouées aux bureaux régionaux de TACIS afin que soient mieux pris en considération dans la mise en oeuvre des programmes les aspects ayant une importance particulière pour les régions; considère qu'il est important que la Commission dispose elle aussi de ressources de personnel suffisantes en vue des nouvelles tâches de coopération transfrontalière;

The following shall be considered to be legal persons of a Member State, a recipient State or a State benefiting from the Phare programme: legal persons who are established in accordance with the legislation of a Member State, a recipient State or a State benefiting from the Phare programme and who have their central administration or principal establishment in the territories in which the Treaty establishing the European Community applies, in the recipient States or in the States benefiting from the Phare programme, or who have their registered office there, where their activity has an actual and continuous link with the economic of the said territories or States.

The PHARE programme was set up under Regulation (EEC) No 3906/89, as last amended by the present Regulation, which provides that funding under the PHARE programme must focus on the main priorities for the adoption of the Community acquis, i.e. building up the administrative and institutional capacities of the applicant States and financing investment, excluding the types of investment financed under the two instruments mentioned above.
Le programme Phare : les financements au titre du programme Phare sont réalisés en conformité aux dispositions du règlement (CEE) n° 3906/89 qui institue ce programme.
