Consequently, in an
action brought by a person covered by the Staff Regulations concerning the legality of an act adversely affecting him, the Civil Service Tribunal can, even of its own motion, in the exercise of its unlimited jurisdiction, award compensation to that person only if that compensation is designed
to make good damage sustained by that person on account of the illegality of the act adversely affecting him and which forms the subject-matter of the action or, at least, damage resulting from an illegality which has a close

Par conséquent, le Tribunal de la fonction publique, saisi, par une personne visée par le statut, d’un recours portant sur la légalité d’un acte lui faisant grief, ne peut, même d’office, en vertu de la compétence de pleine juridiction, accorder une indemnité à cette personne que si ladite indemnité tend à la réparation d’un préjudice subi par celle-ci en raison de l’illégalité de l’acte faisant grief, objet du recours, ou, à tout le moins, d’un préjudice résultant d’une illégalité qui se rattache par un lien étroit à ce même acte.
