These conventions apply world-wide to ship-owners whose vessels are registered in a State Party to the conventions, provide for strict liability for ship-owners, for mandatory financial security, and, in the case of specific types of damage, for special compensation funds which pay any claims in excess of the ship-owners' liability.

Where the beneficial owner is resident in an EU country other than that in which the paying agent is established, the Directive stipulates that the latter must report to the competent authority of the EU country of establishment a minimum amount of information, such as the identity and residence of the beneficial owner, the name and address of the paying agent, the account number of the beneficial owner or, where there is none, identification of the debt claim giving rise to the interest, and information concerning the interest payment.

In the case of shared beneficial ownership, the paying agent shall inform the competent authority of its Member State of establishment or, in the case of a paying agent referred to in Article 4(2), it shall inform the competent authority of the Member State where it has its place of effective management whether the amount reported for each beneficial owner is the full amount attributable to the beneficial owners collectively, the actual share pertaining to the beneficial owner concerned or an equal share.

In other words, until cofinancing is covered by the state, the proprietors of buildings and home owners have to pay the same absolute amount they paid until renovation. The reason is that often, the proprietors of premises and home owners can neither cover cofinancing with their own money nor obtain a bank loan for this.

Calls for the 'polluter pays' principle to be fully enforced at sea by means of a criminal-liability scheme enabling those responsible for incidents to be penalised and by further developing an international compensation fund system, based on the "polluter pays" principle, intended to compensate coastal communities and finance the cleaning-up of the environment; believes that the financing of the fund should be spread over the entire transport chain (flag states, charterers, the owners of the cargo and the owners of the vessel); in addition, believes that the fund shyould consist of two parts: one relating to the carriage of hydrocarbons and the other to the carriage of other hazardous substances;

For the purposes of this Directive, ‘paying agent’ means any economic operator who pays interest to or secures the payment of interest for the immediate benefit of the beneficial owner, whether the operator is the debtor of the debt claim which produces the interest or the operator charged by the debtor or the beneficial owner with paying interest or securing the payment of interest.
