38. est fermement convaincu que l'incertitude juridique et les coûts élevés qui prévalent actuellement dans le domaine des droits de propriété intellectuelle (DPI) contribuent à la fragmentation des efforts en matière de recherche en Europe; invite donc instamment la Commission à procéder à une évaluation des incidences des différents instruments juridiques pouvant être utilisés pour réduire les obstacles existants au transfert des connaissances au sein de l'EER; fait observer que les découvertes enregistrées en bonne et due forme peuvent constituer une source importante de connaissances et que les DPI, notamment le droit applicable en matière de brevets au sein de l’UE, ne peuvent constituer un obstacle au partage des connaissances; souligne l'importance cruciale d'établir un brevet communautaire, ainsi qu'un système juridictionnel pour les brevets européens qui soit de qualité, rentable et propice à l'innovation, tout en étant respectueux des compétences de la Cour de justice des Communautés européennes; prend acte de la communication de la Commission au Parlement européen et au Conseil qui vise à améliorer le système des brevets en Europe (COM(2007)165); observe que le cadre législatif qui en résulte offrira de meilleures incitations pour associer les entreprises privées à la recherche et confortera la position des innovateurs de l’UE à l'échelle internationale;

In view of the rapid advances in the field of biotechnology, the extent of patent protection for genes or gene sequences could be a matter for review in the context of the reports provided for in Article 16(c) of the Directive, with a view to assessing whether various fields of patent protection involving elements isolated or otherwise produced from the human body could be accepted.
