Mr. Chairman, I'm not going to go through—because we have 40 seconds—the different pieces of what we do and name people because I don't frankly know which colour, which political party, our journalists actually vote for when they are in their box.
Monsieur le président, il ne nous reste que 40 secondes. Je ne vais pas parler de tous les aspects de notre travail et citer des noms, parce que bien franchement, je ne sais pas pour quels partis politiques nos journalistes votent lorsqu'ils sont dans l'isoloir.

F. whereas, according to reports, at least 800 activists, including members of opposition parties and journalists, have been arrested amid ongoing demonstrations, in which up to 100 people were reportedly killed by security forces, a toll that prompted the Office of the UN High Commissioner for Human Rights (OHCHR) to call for ‘utmost restraint’ from law enforcement officials; whereas, according to reports, the majority of persons killed are between the ages of 15 and 25, but children as young as 10 to 12 have also been shot by security forces;

M. whereas it is further considered that, in order to promote the public goods of reducing litigation, promoting access to justice, ensuring the proper functioning of the internal market and securing an appropriate balance between freedom of expression and the right to a private life, the Commission should carry out extensive consultations with interested parties, including journalists, the media and specialist lawyers and judges, with a view to proposing the creation of a centre for the voluntary settlement of cross-border disputes arising out of violations of privacy and rights relating to personality, including defamation, by way of alternative dispute resolution (ADR); whereas this would be a much more progressive and 21st-century approach to the resolution of such disputes and facilitate a move towards a more modern mediation-friendly justice culture;
M. considérant en outre que pour promouvoir les biens publics que constituent la réduction du contentieux, la promotion de l'accès à la justice, le bon fonctionnement du marché intérieur et un équilibre approprié entre la liberté d'expression et le droit à la vie privée, la Commission devrait mener des consultations approfondies auprès des parties intéressées, y compris les journalistes, les médias et les juristes et juges spécialisés en la matière, en vue de proposer la création d'un centre pour le règlement volontaire des litiges transfrontières résultant d'atteintes à la vie privée et aux droits de la personnalité, y compris la diffamation, par voie de résolution alternative des conflits; considérant qu'une telle approche en matière de résolution de ces litiges serait bien plus progressiste et conforme à notre temps et contribuerait à avancer vers une culture juridique plus moderne et plus ouverte à la médiation;

3. in the case of testimony involving disclosure of a confidential source of information, journalists should not divulge the identity of the source, even if disclosure is of critical importance to the resolution of litigation, unless the court believes that the public interest requires that the source's identity be revealed: in such cases, the judge will have to render a decision based on both facets of the public interest—namely, resolution of the litigation and freedom of access to the information; in establishing the appropriate balance, the court should also consider all the consequences of the journalist's testimony, particularly for sources themselves, and immediately intervene for the purposes of weighing the two dimensions of the public interest when a party, or the journalist who is being asked to testify as to his or her confidential sources, fails to oppose it.
