Without prejudice to Article 5(1), temporary agency workers shall be given access to the amenities or collective facilities in the user undertaking, in particular any canteen, child-care facilities and transport services, under the same conditions as workers employed directly by the undertaking, unless the difference in treatment is justified by objective reasons.

The competent authorities may impose local public passenger transport services on a transport undertaking if this is essential to safeguard the adequate quality and quantity of a transport service, or to offer special tariffs for certain groups of passengers. This may in particular be the case if the tendering procedure does not produce a result, because within the period specified in the procedure no tenders are received or no tender meets the specified requirements, or if the selected operator cannot provide the service, or does not provide it in accordance with the agreements, as a result of insolvency or termination of contract by the contracting authority.

(4) Community legislation, and in particular Council Regulation (EEC) No 3975/87 of 14 December 1987 laying down the procedure for the application of the rules on competition to undertakings in the air transport sector(6) and Regulation (EEC) No 3976/87 of 14 December 1987 on the application of Article 85(3) of the Treaty to certain categories of agreements and concerted practices in the air transport sector(7), is designed to introduce more competition between carriers providing air transport services to the public.
(4) La réglementation communautaire, et notamment les règlements du Conseil (CEE) n° 3975/87 du 14 décembre 1987 déterminant les modalités d'application des règles de concurrence applicables aux entreprises de transports aériens(6) et (CEE) n° 3976/87 du 14 décembre 1987 concernant l'application de l'article 85, paragraphe 3, du traité à des catégories d'accords et de pratiques concertées dans le domaine des transports aériens(7), vise à introduire plus de concurrence entre les entités fournissant des services de transport aérien au public.

(6) It is desirable to ensure that licensed railway undertakings that operate international goods transport respect the relevant customs and tax provisions applicable, in particular regarding customs transit.
