(2) Council Decision No 971/2006/EC of 19 December 2006 concerning the Specific Programme "Cooperation" implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007-2013) encourages a cross-thematic approach to research topics relevant to one or more themes of the Seventh Framework Programme, and in this context identified an Article 169 (EC Treaty) initiative in the field of Joint Baltic Sea research as one of the fields suitable for Union participation in jointly implemented national research programmes.
(2) La décision 971/2006/CE du Conseil du 19 décembre 2006 relative au programme spécifique "Coopération" mettant en œuvre le septième programme-cadre de la Communauté européenne pour des activités de recherche, de développement technologique et de démonstration (2007-2013) encourage une approche interthématique des sujets de recherche relatifs à un ou plusieurs thèmes du septième programme-cadre et, dans ce contexte, définit l'initiative au titre de l'article 169 (traité CE) dans le domaine de la recherche commune sur la mer Baltique comme l'un des domaines adaptés à une participation de l'Union à des programmes nationaux de recherche mis en œuvre conjointement.

When the possibility for Europol officials to participate in joint investigation teams was introduced by the Protocol amending the Europol Convention (5), it was considered that, given the specificities of the participation of Europol officials in joint investigation teams created by Member States in the context of criminal investigations falling under the competence of Europol, Europol officials should not enjoy immunity from legal proceedings in respect of official acts undertaken when participating in those teams.

National members shall be entitled to participate in joint investigation teams, including in their setting up, in accordance with Article 13 of the Convention on Mutual Assistance in Criminal Matters between the Member States of the European Union or Council Framework Decision 2002/465/JHA of 13 June 2002 on joint investigation teams (8), concerning their own Member State.

1. Where several participants have jointly carried out work generating foreground and where their respective share of the work cannot be ascertained, they shall have joint ownership of such foreground.

Les connaissances résultant de travaux entrepris en commun par plusieurs participants sont la propriété commune desdits participants, qui conviennent entre eux de la répartition des connaissances et des conditions d'exercice de la propriété des connaissances conformément aux dispositions de la présente décision et du contrat.

3. Where several participants have jointly carried out work generating the above knowledge, and in so far as their respective share of the work is not determinable, they shall have joint ownership of such knowledge and shall agree among themselves on the allocation and the terms of exercising the ownership of the knowledge in particular in the consortium contract in accordance with the provisions of this Decision and of the contract.
3. Les connaissances susmentionnées résultant de travaux entrepris en commun par plusieurs participants, et pour autant que leur participation respective aux travaux ne puisse être déterminée, sont la propriété commune desdits participants, qui conviennent, en particulier dans le cadre du contrat de consortium, de la répartition des connaissances et des conditions d'exercice de la propriété des connaissances conformément aux dispositions de la présente décision et du contrat.

The participants shall jointly develop joint technology management plans (TMPs)(2) in respect of the ownership and use, including publication, of information and intellectual property (IP) to be created in the course of joint research.
Les participants élaborent conjointement des programmes de gestion technologique communs (PGT)(2) concernant la propriété et l'utilisation, y compris la publication, des informations et des éléments de propriété intellectuelle (PI) issus des activités de recherche communes.
