IN-CONTEXT TRANSLATIONS

The applicant submits that, in Decision D(2014) 15503, the Secretary-General of the European Parliament decided in an entirely unfounded and unlawful manner that the amount of EUR 37 728 had been unduly paid to the applicant and, in a manner which was unfounded and unlawful under Article 68 of the Implementing Measures for the Statute for Members of the European Parliament and Article 80 of the Rules of Application for the Financial Regulation, instructed the Accounting Officer of the European Parliament to recover from the applicant the payment of EUR 37 728 and, in accordance with the procedure laid down, to notify the applicant of that matter by Debit Note No 2014-575.
Le requérant soutient que le Secrétaire général du Parlement européen a décidé de manière absolument infondée et illégale, par sa décision (D(2014) 15503), qu’une indemnité d’un montant de 37 728 EUR lui avait été indûment versée, et a ordonné sans fondement et illégalement au comptable du Parlement européen, en vertu de l’article 68 des mesures d’application du statut des députés au Parlement européen ainsi que de l’article 80 des règles d’application du règlement financier, de recouvrer auprès du requérant l’indemnité de 37 728 EUR et d’en informer dûment celui-ci, conformément à la procédure, par une note de débit no 2014-575.

Appropriate measures should be taken to prevent irregularities and fraud and the necessary steps should be taken to recover funds lost, wrongly paid or incorrectly used in accordance with Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities’ financial interests (8), Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities (9) and Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) (10).

91. In the present case, the interpretation proposed by the Parliament involves a coercive measure against a parliamentarian (the suspension of some of his allowances so that he repays of his own volition the amounts improperly received), whereas offsetting carried out in accordance with Article 73 of the Financial Regulation and its implementing rules is sufficient to serve the interests of the institution for the purposes of recovering the undue amount.
91 En l’espèce, l’interprétation proposée par le Parlement implique une mesure coercitive contre un parlementaire (la suspension de certaines de ses indemnités afin que ce dernier rembourse de sa propre initiative les montants indûment perçus), tandis qu’une compensation effectuée conformément à l’article 73 du règlement financier et à ses modalités d’exécution suffit à servir les intérêts de l’institution aux fins de la répétition de l’indu.

93. In reply to an oral question, the Parliament also asserted at the hearing that by adopting Article 27(4) of the Rules Governing the Payment of Expenses and Allowances the Bureau intended to create a special rule vis-à-vis that contained in paragraph 3 of the same article, affording certain procedural guarantees to a Member whose debt is recovered by offsetting.

According to the Parliament, if the Secretary-General is satisfied that undue sums have been paid by way of parliamentary allowances (because they have not been used in accordance with the Rules Governing the Payment of Expenses and Allowances), he takes measures to recover them.
