Since 2007 a number of MPs, including a former Prime Minister, have been shielded from criminal investigation by the Parliament’s refusals to allow the opening of criminal investigations.[47] The fact that Parliament does not motivate refusals to allow the opening of criminal investigations makes it difficult to establish the objectivity of decisions.[48] In addition, the fact that parliamentarians can still sit whilst also convicted of serious offences like corruption damages the reputation of Parliament – many parliamentary systems have the practice of suspending parliamentarians at indictment in such cases, and exclusion on conviction.[49]
Depuis 2007, un certain nombre de parlementaires, dont un ancien Premier ministre, ont ainsi été dispensés d'enquête pénale par le refus du Parlement d'autoriser l'ouverture de telles enquêtes à leur encontre[47]. Le fait que le Parlement ne motive pas ses refus d'autoriser l'ouverture d'enquêtes pénales rend difficile l'établissement de l'objectivité des décisions[48]. En outre, le fait que des parlementaires puissent continuer à siéger tout en étant condamnés pour des infractions graves de type corruption entache la réputation du Parlement. Dans nombre de systèmes parlementaires, il est de pratique courante de suspendre les parlementaires mis en accusation dans de telles affaires et de les exclure dès lors qu'ils sont condamnés[49].

Investigations should be conducted in accordance with the Treaties and in particular with Protocol No 7 on the privileges and immunities of the European Union, while respecting the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68 (9) (‘the Staff Regulations’) and the Statute for Members of the European Parliament, and with full respect for human rights and fundamental freedoms, in particular the principle of fairness, for the right of persons involved to express their views on the facts concerning them and for the principle that the conclusions of an investigation may be based solely on elements which have evidential value.

Directive 2002/59/EC of the European Parliament and of the Council of 27 June 2002 establishing a Community vessel traffic monitoring and information system (6) requires Member States to comply with the IMO Code for the Investigation of Marine Casualties and Incidents and ensure that the findings of the accident investigations are published as soon as possible after its conclusion.
