104. Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

In addition to the Council Resolution and the opinion of the European Parliament referred to above, opinions from individual Member States, the Economic and Social Committee, industry and other stakeholders have been taken into account.
Outre la résolution du Conseil et l'avis du Parlement européen précédemment mentionnés, l'avis des Etats membres, du Comité économique et social, des entreprises et des autres acteurs intéressés a également été pris en compte.

According to this opinion, the use of bones for the production of collagen should not to be considered as a risk for public health It is therefore appropriate to lay down processing requirements in accordance with the opinion of EFSA and specify that the bones used as raw material have to be other than specified risk material as defined in Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May 2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies .
Selon cet avis, l’utilisation d’os dans la production de collagène ne doit pas être considérée comme entraînant un risque pour la santé publique. Il convient donc de fixer des exigences de traitement conformes à l’avis de l’EFSA, en précisant que les os utilisés comme matières premières ne peuvent être des matériels à risque spécifiés au sens du règlement (CE) no 999/2001 du Parlement européen et du Conseil du 22 mai 2001 fixant les règles pour la prévention, le contrôle et l’éradication de certaines encéphalopathies spongiformes transmissibles .

4. Member States shall ensure that the appropriate bodies referred to in Article 10 of Directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008 on common standards and procedures in Member States for returning illegally staying third-country nationals have the right to lodge an application for international protection on behalf of an unaccompanied minor if, on the basis of an individual assessment of his or her personal situation, those bodies are of the opinion that the minor may have protection needs pursuant to Directive 2011/95/EU.

Les États membres font en sorte que les organismes compétents visés à l’article 10 de la directive 2008/115/CE du Parlement européen et du Conseil du 16 décembre 2008 relative aux normes et procédures communes applicables dans les États membres au retour des ressortissants de pays tiers en séjour irrégulier aient le droit d’introduire une demande de protection internationale pour le compte d’un mineur non accompagné si, sur la base d’une appréciation spécifique de la situation particulière de ce dernier, ces organismes estiment que le mineur peut avoir besoin d’une protection en vertu de la directive 2011/95/UE.

6. Member States shall ensure that the appropriate bodies referred to in Article 10 of Directive 2008/115/EC of the European Parliament and of the Council [17] have the right to lodge an application for international protection on behalf of an unaccompanied minor if, on the basis of an individual assessment of his/her personal situation, these bodies are of the opinion that the minor may have protection needs pursuant to Directive [../../EC] [the Qualification Directive].

We do not, for example, consider that the European Parliament should concern itself with treatment programmes at correctional institutions or the treatment of gambling addiction. Nor should the European Parliament have opinions on the regime under which Member States choose to operate their health care, and we do not accept the assertion that deregulation would damage the quality of care.

After more than three years of fierce negotiations, after two markedly different proposals, despite a European Parliament opinion expressing support for the first proposal and despite the excellent work done by our rapporteur, the text that we have today contains minimal provisions on family reunification and, moreover, the Council will take absolutely no account at all of the European Parliament's opinion, which will nevertheless – at least, I hope so – confirm our previous position.

The European Parliament has expressed its opinions on the different proposals for legislation which have been submitted to it, and has not hesitated to express a negative opinion when it has felt that their content corresponded only partly, if at all, to the intended line of policy.
