Prison sentences are sometimes necessary, but if we are sending youths to prison for the first time, we should realize that there is convincing data to suggest that this experience increases rather than decreases the likelihood of subsequent offending. The change that is proposed to paragraph 39(1)(c) equates extrajudicial sanctions with findings of guilt.
