3. This Decision shall apply to all the persons who, for the purposes of paragraph 3a of Article 4 of Decision (EU) 2015/1601, have been admitted from the territory of Turkey by the Member States as from 1 May 2016.

Therefore, the Canadian Turkey Marketing Agency, pursuant to paragraph 22(1)(f) of the Farm Products Marketing Agencies Act and section 2 of Part II of the schedule to the Canadian Turkey Marketing Agency Proclamation, CRCxttt, c. 647, hereby revokes the Canadian Turkey Marketing Quota Regulations, CRCxttt, c. 661, and makes the annexed Regulations respecting the establishment of a quota system by which quotas are assigned by provincial Commodity Boards to turkey producers for the marketing of turkey in interprovincial and export trade, in substitution therefor, effective May 2, 1990.

3. For the purposes of applying subparagraphs (a) and (b) of paragraph 1 to a company that is a resident of Canada, tax payable in Turkey shall include any tax which would have been payable in Turkey in respect of profits attributable to an active business carried on in Turkey for a taxation year, but for an exemption from or reduction of tax granted for that year, or any part thereof, under special tax measures in Turkey insofar as such measures were in force on, and have not been modified since, the date of signature of the Agreement or have been modified only in minor respects so as not to affect their general character.
3. Pour l’application des alinéas a) et b) du paragraphe 1 à une société qui est un résident du Canada, l’impôt dû en Turquie comprend l’impôt qui y aurait été dû à l’égard des bénéfices imputables à une entreprise exploitée activement en Turquie pour une année d’imposition n’eût été une exonération ou une réduction d’impôt accordée pour cette année, ou une partie de celle-ci, conformément à des mesures fiscales spéciales en Turquie, pour autant qu’elles aient été en vigueur à la date de signature de l’Accord et n’aient pas été modifiées depuis, ou qu’elles n’aient fait l’objet que de modifications mineures sans effet sur leur caractère général.

(c) during the six month period beginning on January 1 and ending on June 30 of any calendar year, applicants referred to in paragraphs (a) and (b) who submit an additional application and all other applicants shall receive a share of any remaining portion of the import access quantity for turkey and turkey products equal or less than the quantity of turkey and turkey products for which they apply, on a first-come first-served basis; and
c) les requérants visés aux alinéas a) et b) qui en font une demande supplémentaire et les autres requérants se partagent, durant la période de six mois de chaque année civile commençant le 1 janvier et se terminant le 30 juin tout solde de la quantité de dindons, de dindes et de leurs produits visée par le régime d'accès en cause, selon le principe du premier arrivé, premier servi, jusqu'à concurrence de la quantité demandée;

(d) in respect of the six month period beginning on July 1 and ending on December 31 of any calendar year, each applicant referred to in paragraph (a) shall receive a share of any remaining portion of the import access quantity for turkey and turkey products, in proportion to its share of the total of all historical import quotas for turkey and turkey products.

2. The prohibition in paragraph 1 shall apply to any arrangement for refund, remission or non-payment, partial or complete, of customs duties or charges having an equivalent effect, applicable in the Community or in Turkey to materials used in the manufacture and to products covered by paragraph 1(b), where such refund, remission or non-payment applies, expressly or in effect, when products obtained from the said materials are exported and not when they are retained for home use there.
2.
