Where the Commission decides not to give the authorisation referred to in paragraph 3 the approval authority shall immediately notify the holder of the provisional EU type-approval referred to in paragraph 4 that the provisional EU type-approval will be revoked six months after the date of the Commission's refusal.

Where an approval authority which has granted an EU type-approval establishes that the arrangements referred to in paragraph 1 are not being applied, deviate significantly from the arrangements agreed as referred to in paragraph 1, have ceased to be applied or are no longer considered to be adequate, even though production is continuing, it shall either take the necessary measures to ensure that the procedure for conformity of production is followed correctly, or shall withdraw the EU type-approval.
5. The Commission shall, within six months from the date of receiving the notification provided for in this paragraph , approve or reject the national provisions after having verified, taking into account the high level of protection of human health achieved through this Directive, whether or not they are justified, necessary and proportionate to their aim and whether or not they are a means of arbitrary discrimination or a disguised restriction on trade between the Member States.

An approval authority which has granted an EU type-approval shall take the necessary measures in relation to that approval to verify, if necessary in cooperation with the approval authorities of the other Member States, that the arrangements referred to in paragraphs 1 and 2 continue to be adequate so that vehicles, systems, components or separate technical units in production will continue to conform to the approved type and certificates of conformity continue to comply with Article 38.

I am frankly shocked that some of what has been said here seem to clearly contradict more than thirty paragraphs approved in the resolutions that Parliament adopted for the Seville, Madrid and Barcelona summits, which definitely had the support and the vote of the Parliamentary Socialist Group.
Et, pour parler franchement, je suis choqué de voir qu’un certain nombre des déclarations émises ici semblent être en nette contradiction avec plus de trente paragraphes approuvés dans les résolutions adoptées par ce Parlement à l'occasion des sommets de Séville, de Madrid et de Barcelone et qui ont bien sûr bénéficié du soutien et du vote favorable du groupe parlementaire socialiste.
