10 (a) Unless the Parties agree otherwise, within five working days of the date of the selection of the arbitrators, the terms of reference of the arbitration panel shall be: "to examine, in the light of the relevant provisions of the Association Agreement, the matter referred to in the request for establishment of the arbitration panel, to rule on the compatibility of the measure in question with the provisions referred to in Article 2 of the Protocol and to make a ruling in accordance with Article 8 of the Protocol on Dispute Settlement".

2. In the event of disagreement between the Parties concerning the existence of any measure notified under paragraph 1 or its consistency with the provisions referred to in Article 2, the complaining Party may request in writing the arbitration panel to rule on the matter.

In June 2001 Brazil requested the establishment of a WTO panel to rule on the WTO-conformity of an anti-dumping measure imposed by the EU in 2000 on imports of malleable fittings from Brazil. Brazil challenged the EU measures on an unusually high number of grounds virtually covering the entire WTO Anti-Dumping Agreement. The panel report issued in March 2003 confirmed the EU findings on all major aspects of the investigation, including the existence of dumping and the injury caused by those dumped imports to the Community industry.

Upon that notification, that other Party may request the original arbitration panel to rule on the conformity of those measures with this Part of the Agreement if they are not similar to the measures which the arbitration panel, acting under paragraph 4, has ruled that they would be consistent with this Part of the Agreement.

At the request of any of the Parties, the original arbitration panel shall rule on the conformity with this Part of the Agreement of any implementing measures adopted after the suspension of benefits and, in the light of such ruling, whether the suspension of benefits should be terminated or modified.

A WTO Panel has ruled that a US safeguard quota imposed on the import of wheat gluten falls foul of WTO rules. In the Panel report the US wheat gluten quota was found to have violated the WTO Agreement on Safeguards.
