Subject to the arrangements agreed under paragraph 12 of this Annex, a vessel employed for the time being in fishing for tuna or tuna-like fishes in the Convention Area outside the waters within its national jurisdiction shall stop when given the appropriate signal in the International Code of Signals by a ship carrying an inspector unless it is actually carrying out fishing operations, in which case it shall stop immediately once it has finished such operations.

3. Each Member State shall, at least 15 days before the start of the operation, transmit the information referred to in paragraph 2 to the Commission in accordance with the format set out in Annex V. The Commission shall promptly forward that information to the ICCAT Secretariat and to the flag State of other fishing vessels participating in the joint fishing operation at least 10 days before the start of the operation.
3. Les États membres transmettent à la Commission les informations visées au paragraphe 2, au plus tard quinze jours avant le début de l'opération, conformément au modèle présenté à l'annexe V. The technical measures provided for in this Regulation shall not apply to fishing operations conducted solely for the purpose of artificial restocking or transplantation of marine species, provided that those operations are carried out with the permission and under the authority of the Member State or Member States having a direct management interest.

Based on the scientific evidences provided in the joint recommendation, the revision by the STECF and taking into account the characteristics of the gears, the high number of species in each fishing operations, the fishing patterns and the particularities of the Mediterranean Sea (e.g. predominance of small-scale fisheries), the Commission considers that, in order to avoid disproportionate costs of handling unwanted catches and in accordance with Article 15(5)(c)(ii) of Regulation (EU) No 1380/2013, it is appropriate to establish a de minimis exemption in accordance with the percentage level proposed in the joint recommendations, within the limits set out in Article 15(5)(c) of Regulation (EU) No 1380/2013.
En se fondant sur les preuves scientifiques accompagnant la recommandation commune, ainsi que sur la révision par le CSTEP et en tenant compte des caractéristiques des engins de pêche, du nombre élevé d'espèces dans chacune des opérations de pêche, des structures de pêche et des particularités de la mer Méditerranée (par exemple prédominance des petites pêcheries), la Commission estime que, afin d'éviter des coûts disproportionnés liés au traitement des captures indésirées et conformément à l'article 15, paragraphe 5, point c) ii), du règlement (UE) no 1380/2013, il convient d'établir une exemption de minimis à un niveau correspondant au pourcentage proposé dans les recommandations communes, dans les limites fixées à l'article 15, paragraphe 5, point c), dudit règlement.

"(b) The Commission shall be empowered to adopt delegated acts in accordance with Article 48a concerning the method of calculation of the percentages of target species and of other species retained on board when these have been taken by a net or nets towed simultaneously by more than one fishing vessel, and the method of verification for ensuring that any fishing vessels involved in the joint fishing operation that retain fish on board comply with the percentages of species as set out in Annexes I to V".

1. Recognises that artisanal coastal fishing, shellfishing and carefully regulated and well-managed extensive aquaculture are the forms of fishing that are sustainable from a social, economic and environmental perspective, and which also constitute a determining factor for the socio-economic development of coastal communities; stresses that these forms of fishing have a considerable cultural impact and are territorially very diverse, being carried out on the mainland, on islands and in the outermost regions; points out that they are affected by negative factors such as lack of effective water treatment, human-made and natural disasters, competition from large-scale fishing operations, spills, oil slicks, excessive growth of seaboard construction, the effects of large projects on coasts, the effects of climate change, and the lack of clearly-defined regulatory regimes for sustainable local development, and are also vulnerable to changes in local employment patterns;
1. reconnaît que la pêche artisanale côtière, la pêche aux coquillages et l'aquaculture extensive rigoureusement réglementée et bien gérée sont les formes de pêche les plus durables d'un point de vue social, économique et environnemental et sont également essentielles pour le développement socio-économique des communautés côtières; relève que ces formes de pêche sont marquées par une forte empreinte culturelle et une grande diversité territoriale sur le continent, dans les îles et dans les régions ultrapériphériques; souligne qu'elles sont touchées par des facteurs négatifs comme l'absence de traitement efficace des eaux, les catastrophes naturelles engendrées par l'homme, la concurrence de la pêche industrielle à grande échelle, les déchets, les marées noires, la croissance démesurée de l'urbanisation le long du littoral, l'impact de grands projets sur les côtes, les conséquences liées au changement climatique et l'absence de régimes réglementaires clairement définis pour le développement local durable; rappelle qu'elles sont également sensibles aux changements dans les caractéristiques du marché du travail au niveau local;

K. whereas sound management of resources in line with the precautionary principle and the principle of sustainable development requires the strengthening of existing control mechanisms so that the flag State and the coastal State where vessels are operating can access information in real time on the vessel's location and the fishing operations being carried out whenever they wish,
