Hopes that under the leadership of Prime Minister Hailemariam Desalegn, appointed on 21 September 2012, Ethiopia will engage in a process of genuine democratic transition in order to realise its strong democratic potential, putting an end to interference with religious freedom and civil society freedoms; calls on the European External Action Service, the EUSR for the Horn of Africa and the EUSR for Human Rights to engage with Ethiopia on human rights as a matter of priority so that it can seize the opportunity of the ongoing political transition to institute a truly democratic transition, built on the centrality of human rights and fundamental freedoms, freedom of the media and full recognition of freedom of expression; urges the EU and the international community to remain vigilant and active in response to the political transition under way in Ethiopia, to promote the strengthening of democratic institutions and to tie political, military and development assistance to concrete democratic reforms, which must include the release of all prisoners of conscience, such as Eskinder Nega and other journalists, human rights and development activists and opposition figures, the admission of the UN special rapporteurs on human rights on a basis of unhindered access to all regions and detention facilities, the repeal or amendment of the Charities and Societies Proclamation and the Anti-Terrorism Proclamation, and the return of opposition politicians in exile; calls on the EU to find innovative and secure ways to assist, financially and politically, the struggling civil society in Ethiopia and engage in close dialogue with the opposition, both in Ethiopia and in exile;

I therefore support: the recognition of the need for the work of migrants within the EU; the need for increased consultation with representatives of civil society; freedom of movement within the EU following a period of five years’ residence; respect for human dignity and the application of the most favourable measures in the context of the application of the Return Directive; and, finally, and most importantly, the right to vote in local elections, a point to which the European right was fiercely opposed.

(9) The free movement of information society services can in many cases be a specific reflection in Community law of a more general principle, namely freedom of expression as enshrined in Article 10(1) of the Convention for the Protection of Human Rights and Fundamental Freedoms, which has been ratified by all the Member States; for this reason, directives covering the supply of information society services must ensure that this activity may be engaged in freely in the light of that Article, subject only to the restrictions laid down in paragraph 2 of that Article and in Article 46(1) of the Treaty; this Directive is not intended to affect national fundamental rules and principles relating to freedom of expression.
(9) Dans bien des cas, la libre circulation des services de la société de l'information peut refléter spécifiquement, dans la législation communautaire, un principe plus général, à savoir la liberté d'expression, consacrée par l'article 10, paragraphe 1, de la convention de sauvegarde des droits de l'homme et des libertés fondamentales, qui a été ratifiée par tous les États membres. Pour cette raison, les directives couvrant la fourniture de services de la société de l'information doivent assurer que cette activité peut être exercée librement en vertu de l'article précité, sous réserve uniquement des restrictions prévues au paragraphe 2 du même article et à l'article 46, paragraphe 1, du traité. La présente directive n'entend pas porter atteinte aux règles et principes fondamentaux nationaux en matière de liberté d'expression.

(5) The development of information society services within the Community is hampered by a number of legal obstacles to the proper functioning of the internal market which make less attractive the exercise of the freedom of establishment and the freedom to provide services; these obstacles arise from divergences in legislation and from the legal uncertainty as to which national rules apply to such services; in the absence of coordination and adjustment of legislation in the relevant areas, obstacles might be justified in the light of the case-law of the Court of Justice of the European Communities; legal uncertainty exists with regard to the extent to which Member States may control services originating from another Member State.
(5) Le développement des services de la société de l'information dans la Communauté est limité par un certain nombre d'obstacles juridiques au bon fonctionnement du marché intérieur qui sont de nature à rendre moins attrayant l'exercice de la liberté d'établissement et de la libre prestation des services. Ces obstacles résident dans la divergence des législations ainsi que dans l'insécurité juridique des régimes nationaux applicables à ces services. En l'absence d'une coordination et d'un ajustement des législations dans les domaines concernés, des obstacles peuvent être justifiés au regard de la jurisprudence de la Cour de justice des Communautés européennes. Une insécurité juridique existe sur l'étendue du contrôle que les États membres peuvent opérer sur les services provenant d'un autre État membre.
