Without prejudice to the rules on cross-border cooperation and mutual legal assistance in criminal matters and to other rules under Union law, in particular under Regulation (EU, Euratom) No 883/2013 of the European Parliament and of the Council , there is a need for appropriate provision to be made for cooperation to ensure effective action against the criminal offences defined in this Directive affecting the Union's financial interests, including exchange of information between the Member States and the Commission as well as technical and operational assistance provided by the Commission to the competent national authorities as they may need to facilitate coordination of their investigations.
Sans préjudice des règles en matière de coopération transfrontière et d'entraide judiciaire en matière pénale et d'autres règles prévues par le droit de l'Union, en particulier par le règlement (UE, Euratom) no 883/2013 du Parlement européen et du Conseil , il est nécessaire de prévoir des dispositions adéquates concernant la coopération en vue d'assurer une action efficace contre les infractions pénales, définies dans la présente directive, qui portent atteinte aux intérêts financiers de l'Union, notamment l'échange d'informations entre les États membres et la Commission, ainsi qu'une assistance technique et opérationnelle de la Commission aux autorités nationales compétentes dans la mesure où il peut être nécessaire de faciliter la coordination de leurs enquêtes.

(23) Member States should establish their jurisdiction in coherence with the Geneva Convention and the provisions on jurisdiction in other Union criminal law legislation, that is to say, for offences committed on their territory and for offences committed by their nationals.
(23) Les États membres devraient établir leur compétence en cohérence avec la convention de Genève et les dispositions relatives à la compétence figurant dans d’autres actes législatifs de l’Union en matière pénale, c’est-à-dire pour les infractions commises sur leur territoire et pour les infractions commises par leurs ressortissants.

(23) Member States should establish their jurisdiction in coherence with the Geneva Convention and the provisions on jurisdiction in other Union criminal law legislation, that is to say, for offences committed on their territory and for offences committed by their nationals, noting that offences are best dealt with by the criminal justice system of the State where they occur .The principle of ne bis in idem has to be respected, which means that no prosecutions should be brought against those who have been finally convicted or acquitted in a previous trial.
(23) Les États membres devraient établir leur compétence en cohérence avec la convention de Genève et les dispositions relatives à la compétence figurant dans d'autres actes législatifs de l'Union en matière pénale, c'est-à-dire pour les infractions commises sur leur territoire et pour les infractions commises par leurs ressortissants, tout en notant qu'il est préférable que les délits soient traités dans le système de justice pénale de l'État où ils sont commis. (22) Member States should establish their jurisdiction in a manner consistent with the Geneva Convention and the provisions on jurisdiction in other Union criminal law, that is to say, over offences committed on their territory and over offences committed by their nationals, noting that in general offences are best dealt with by the criminal justice system of the country in which they occur .

Restrictions concerning specific principles and the rights of information, access to and rectification or erasure of personal data, the right to data portability, the right to object, decisions based on profiling, as well as the communication of a personal data breach to a data subject and certain related obligations of the controllers may be imposed by Union or Member State law, as far as necessary and proportionate in a democratic society to safeguard public security, including the protection of human life especially in response to natural or manmade disasters, the prevention, investigation and prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security, or of breaches of ethics for regulated professions, other important objectives of general public interest of the Union or of a Member State, in particular an important economic or financial interest of the Union or of a Member State, the keeping of public registers kept for reasons of general public interest, further processing of archived personal data to provide specific information related to the political behaviour under former totalitarian state regimes or the protection of the data subject or the rights and freedoms of others, including social protection, public health and humanitarian purposes.

On the other hand, there are still many serious shortcomings to be rectified in the body of criminal law with which the European Union seeks to combat fraud.
En revanche, il subsiste encore des lacunes importantes en ce qui concerne la dimension pénale de la lutte européenne contre la fraude.

In order to guarantee tighter and harmonised criminal protection for the euro throughout the European Union, the Council adopted on 29 May 2000 Framework Decision 2000/383/JHA[1] on increasing protection by criminal penalties and other sanctions against counterfeiting in connection with the introduction of the euro, which was amended by Framework Decision 2001/888/JHA on 6 December 2001[2] in order to introduce for the purpose of recognising repeat offences a provision concerning the mutual recognition of convictions handed down in another Member State.
Afin d’assurer une protection pénale renforcée et harmonisée de l’euro dans toute l’Union européenne, le Conseil a adopté, le 29 mai 2000, la décision-cadre 2000/383/JAI[1] visant à renforcer par des sanctions pénales et autres la protection contre le faux-monnayage en vue de la mise en circulation de l’euro. Cette décision-cadre a été modifiée par la décision-cadre 2001/888/JAI du 6 décembre 2001[2], qui y a introduit une disposition relative à la reconnaissance des condamnations prononcées par les juridictions des autres États membres en vue d’établir la récidive.

– (DE) Mr President, I believe that this criminal court is of tremendous importance and I should like to say to Mrs Thors that the Member States of the European Union should do their own homework before asking others to do it for us. That does not mean that others should not do theirs, it means that we must ensure as a matter of urgency that this criminal court is up and running soon.

With regard to mediation in criminal cases, it is important to look at whether it is necessary to take measures at European Union level other than those laid down in Article 10 of the Council Framework Decision of 15 March 2001 on the standing of victims in criminal proceedings, [121] to harmonise certain conditions and practical arrangements for mediation in criminal cases in order to facilitate the recognition of measures and arrangements arising from mediation procedures and their implementation in another Member State.
Quant à la médiation pénale, il importe d'examiner s'il convient de prévoir, au niveau de l'Union européenne et au-delà des exigences de l'article 10 de la décision-cadre du Conseil du 15 mars 2001 relative au statut des victimes [121] dans le cadre de procédures pénales, un rapprochement de certaines conditions et modalités d'application de la médiation pénale, afin de faciliter la reconnaissance des mesures et arrangements issus de procédures de médiation pénale et leur exécution dans un autre État membre.
