(Return tabled) Question No. 374 Ms. Françoise Boivin: With regard to the projected cost of implementing Bill C-10, An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts, over the next ten years, divided by year: (a) what will be the total cost to the federal government; (b) what will be the total cost to each province and territory; (c) divided by estimated federal and provincial/territorial costs, (i) what will be the total cost for prison infrastructure, for changes to the Young Offender Act, of the new and increased mandatory minimum sentences, of eliminating conditional sentences, and of increased penalties for drug crimes, (ii) how were these projected costs arrived at, (iii) what was the methodology involved in calculating these costs, (iv) who was tasked with calculating these costs; and (d) what are the titles of the studies or reports done by or on behalf of the government that cover, in whole or in part, the subject of Bill C-10?

Question No. 470 Mr. Mark Holland: With regard to the implementation of Bill C-4, An Act to amend the Youth Criminal Justice Act and to make consequential and related amendments to other Acts, Bill C-16, An Act to amend the Criminal Code, Bill C-21, An Act to amend the Criminal Code (sentencing for fraud), Bill C-39, An Act to amend the Corrections and Conditional Release Act and to make consequential amendments to other Acts, Bill S-6, An Act to amend the Criminal Code and another Act, Bill S-9, An Act to amend the Criminal Code (auto theft and trafficking in property obtained by crime) and Bill S-10, An Act to amend the Controlled Drugs and Substances Act and to make related and consequential amendments to other Acts, for each Bill: (a) how many additional prisoners are projected to be housed in Correctional Service of Canada institutions over the next ten years, broken down annually; (b) what is the projected cost associated with building new infrastructure to absorb the influx of these additional prisoners over the next ten years, broken down annually; and (c) what is the projected cost associated with operating and managing these additional prisoners over the next ten years, broken down annually?

Projects running after the end of 2015 will have their allocated funding beyond that date cut, whereas for some other projects, a reduction of TEN-T funding is foreseen as a result of an inability to meet critical objectives.

For example, such information may already be available in the context of Regulation(EC) No 2236/95, in the context of other Community legislation which can provide cofinancing to TEN-projects and the decisions approving individual projects under those legislative instruments, and in the context of Directives 2003/54/EC and 2003/55/EC concerning common rules for the internal market for electricity and gas.

We did try to help you out of your difficulties, making it clear to you that the TEN projects’ Annex III, the priority projects, is a matter for our joint decision, and that the Council cannot draw up its own special list from among these priority projects, effectively saying that, of the 30 projects, it finds this one and that one and the other one the most attractive, and that it is now deciding to start with those.

I hope, therefore, that this sitting will at least have been useful in two ways. On the one hand, it has sought to clarify the procedure so that we can see whether or not we are within the codecision framework – and we shall have to have a very clear answer on that subject – and on the other hand, if we are not involved in a codecision procedure, it has at least made provision for an annual report on the implementation of the TEN projects which we have voted in favour of.

What I am sure about, however, since it was I, together with a number of other Members, who called for it is that we must have regular information about the implementation of the thirty TEN projects which we shall be voting in favour of.

These sections are lagging further behind than any other priority projects; which justifies increased support; recourse to public-private partnership (PPP) could provide solutions "for some projects", but, given the "cost and risks", "private capital injections will be lower "; the CoR recognises the importance of the EIB's role but notes that this contribution would not be enough to finance all of the major projects; the CoR calls for greater synergy of TEN-Ts with the Structural Funds but warns against using the cohesion funds to finance TEN-Ts; to find new sources of revenue, the creation of "charges for a specific purpose" such as "user charge stickers" could be considered.
