Is the Memorandum of Understanding between the European Community and Romania of 23 June 2009 to be interpreted as allowing the European Commission to require, for the purposes of reducing the effects of the economic crisis, the adoption of a national law which completely and indefinitely withdraws a person’s right to receive a contributory pension accrued over more than 30 years, which was legally established and received before that law came into force, on the ground that the person in question receives a salary for activity, carried out on the basis of an employment contract, other than the activity in respect of which he receives the pension?
Le mémorandum du 23 juin 2009 d’entente entre la Communauté européenne et la Roumanie doit-il être interprété en ce sens que, en vue de la réduction de la crise économique, la Commission européenne peut valablement imposer l’adoption d’une loi nationale privant une personne, entièrement et sine die, de son droit de percevoir la pension contributive pour plus de 30 ans de cotisations, fixée conformément à la loi et perçue antérieurement à ladite loi, au motif que cette personne perçoit un salaire pour une activité exercée au titre d’un contrat de travail, différente de celle pour laquelle elle a été mise à la retraite?

If the answer is in the affirmative, is the Memorandum of Understanding between the European Community and Romania of 23 June 2009, published in Monitorul Oficial No 455 of 1 July 2009, to be interpreted as allowing the European Commission to require, for the purposes of reducing the effects of the economic crisis by reducing staff costs, the adoption of a national law which withdraws a person’s right to receive a contributory pension accrued over more than 30 years, which was legally established and received before that law came into force, on the ground that the person in question receives a salary for activity, carried out on the basis of an employment contract, other than the activity in respect of which he receives the pension?
Dans l’affirmative, le mémorandum du 23 juin 2009 d’entente entre la Communauté européenne et la Roumanie, publié au Monitorul Oficial no 455 du 1er juillet 2009, doit-il être interprété en ce sens que, en vue de la réduction des effets de la crise économique par la réduction des frais de personnel, la Commission européenne peut valablement imposer l’adoption d’une loi nationale privant une personne de son droit de percevoir la pension contributive pour plus de 30 ans de cotisations, fixée conformément à la loi et perçue antérieurement à ladite loi, au motif que cette personne perçoit un salaire pour une activité exercée au titre d’un contrat de travail, différente de celle pour laquelle elle a été mise à la retraite?

Undisclosed information communicated under the Agreement, and received from the other Party, may be disseminated by the receiving Party to persons within or employed by the receiving Party and other concerned departments or agencies of the receiving Party authorized for the specific purposes of the joint research underway, provided that any undisclosed information so disseminated shall be pursuant to a written agreement of confidentiality and shall be readily recognizable as such, as set out above.

Les informations à ne pas divulguer communiquées par l'une des parties dans le cadre du présent accord peuvent être diffusées par la partie destinataire aux personnes qui la composent ou qu'elle emploie ainsi qu'à ses autres ministères ou agences concernés qui sont spécifiquement autorisés aux fins de la recherche commune en cours, à condition que lesdites informations soient diffusées en vertu d'un accord écrit de confidentialité et que leur caractère confidentiel soit aisément reconnaissable conformément aux dispositions ci-dessus.
