They are characterized by repeated acts that have no clear rational motivation, cannot be controlled, and generally harm the patient's own interests and those of other people. The patient reports that the behaviour is associated with impulses to action. The cause of these disorders is not understood and they are grouped together because of broad descriptive similarities, not because they are known to share any other important features.

By their sixth ground of appeal, the appellants submit that the General Court erred in law when it ruled, in paragraphs 100 and 103 and also in paragraphs 108 and 110, that the consistency of the restrictive measures adopted by the European Union with the principles of legal certainty and of foreseeability of the law, from which it follows that those measures must be clear and precise, is to be verified in the light of the rules of the case-law as to the uniform interpretation of acts of the European Union, which require that those acts be interpreted and applied in the light of the versions existing in the other official languages.

(27) The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union, in order to determine the procedures under which AIFM managing portfolios of AIF whose assets under management do not exceed the threshold set out in this Directive may exercise their right to be treated as AIFM covered by this Directive. These delegated acts may also specify the criteria to be used by competent authorities to assess whether AIFM comply with their obligations as regards their conduct of business, the type of conflicts of interests AIFM have to identify, as well as the reasonable steps AIFM are expected to take in terms of internal and organizational procedures in order to identify, prevent, manage and disclose conflicts of interest. They may specify the risk management requirements to be employed by AIFM as a function of the risks which the AIFM incurs on behalf of the AIF that it manages as well as any arrangements needed to enable AIFM to manage the particular risks associated with short selling transactions, including any relevant restrictions that might be needed to protect the AIF from undue risk exposures. They may specify the liquidity management requirements of this Directive and in particular the minimum liquidity requirements for AIF, they may specify the requirements that originators of securitisation instruments have to meet in order for an AIFM to be allowed to invest in such instruments issued after 1 January 2011. I therefore believe that the forthcoming EU-US Summit to be held in Washington on 2 May will be a good opportunity for the Presidency of the Council and the Presidency of the Commission to remind the United States’ President that the spirit of the Transatlantic Declaration, which, as has been mentioned, was signed in 1995, binds the parties to maintain a spirit of cooperation, to seek common ground and not to seek ground that separates us and, in the fine tradition of the intense relationship between the United States and Europe, it is in the interests of both parties, the United States and Europe, to seek points of agreement and not of disagreement.
