(2) Where the board of a Canadian carrier has information concerning the beneficial ownership, or control, of the Canadian carrier that causes the board to believe that the Canadian carrier is not eligible to operate pursuant to section 16 of the Act and the Canadian carrier intends to take further action pursuant to these Regulations, the Canadian carrier shall, in respect of its voting shares that are publicly traded, immediately make a public announcement to this effect, whether by press release, newspaper advertisement or by any other manner that is reasonably expected to inform the markets in which voting shares are traded, and shall immediately forward a copy of the announcement to the Commission.

(5) Where the board of the Canadian carrier determines that the shares are excess voting shares and that a sale or other disposition of excess voting shares is required in order to reduce the total number of voting shares of the carrier that are excess voting shares to zero, in the case of a carrier referred to in subsection 16(1) of the Act, or to zero or to any percentage such that the percentage of the voting shares that is beneficially owned, and controlled, by non-Canadians is within five per cent of the percentage of the voting shares of the corporation that were beneficially owned, and controlled, by non-Canadians as at July 22, 1987, in the case of a carrier referred to in subsection 16(2) of the Act, the Canadian carrier shall send a notification to the registered holder of the excess voting shares,

(4) Notwithstanding any other provision of these Regulations, any toll respecting the carriage of goods for remuneration on an aircraft used for an ABC, an ABC/ITC, a CPC or an ITC in the tariff of a non-Canadian air carrier on file with the Agency shall be disallowed by the Agency if that toll is less than the lowest such toll that is in any Canadian air carrier’s tariff on file with the Agency and in effect and that, pursuant to the terms and conditions of the Canadian air carrier’s tariff, could apply to such transportation as is covered by the non-Canadian air carrier’s toll.
(4) Nonobstant toute autre disposition du présent règlement, la taxe qui est inscrite au tarif déposé auprès de l’Office par un transporteur aérien non canadien et qui vise le transport de marchandises contre rémunération à bord d’un aéronef affecté à un VARA, un VARA/VAFO, un VABC ou un VAFO est refusée par l’Office si elle est inférieure à la taxe analogue la plus basse du tarif en vigueur qu’un transporteur aérien canadien a déposé auprès de l’Office et qui, aux termes des conditions dont le tarif est assorti, peut s’appliquer au transport visé par la taxe du transporteur aérien non canadien.

(8) Notwithstanding any other provision of these Regulations, any toll contained in the ABC tariff of a non-Canadian air carrier on file with the Agency shall be disallowed if that toll is less than the lowest ABC toll in the ABC tariff of any Canadian air carrier on file with the Agency and in effect that, pursuant to the terms and conditions of the Canadian air carrier’s ABC tariff, could apply to such ABC transportation as is covered by the non-Canadian air carrier’s toll.
(8) Nonobstant toute autre disposition du présent règlement, la taxe contenue dans le tarif VARA qu’un transporteur aérien non canadien dépose auprès de l’Office est refusée si elle est inférieure à la taxe VARA en vigueur la plus basse contenue dans le tarif qui a été déposé auprès de l’Office par un transporteur aérien canadien et qui, selon les conditions dont ce tarif est assorti, pourrait s’appliquer au VARA visé par la taxe du transporteur aérien non canadien.

8 (1) A Canadian carrier may refuse to accept any subscription for, issue, register the transfer of, purchase or otherwise acquire, any of its voting shares unless a declaration is submitted to the Canadian carrier and the Canadian carrier determines that the effect of the information appearing on the declaration, together with any other information in any books or records of the Canadian carrier, its transfer agent or its registrar is that the subscription, issue, transfer, purchase or acquisition would not result in
