An internal armed conflict must be found to exist where a State’s armed forces confront one or more armed groups or where two or more armed groups confront each other, regardless of the intensity of the confrontations, the level of organisation of the armed forces involved or the duration of the conflict

The Court considers first whether a case where the person concerned has been a member of an organisation on the list and has actively supported the armed struggle waged by that organisation – and perhaps occupied a prominent position within that organisation – is a case of ‘serious non-political crime’ or ‘acts contrary to the purposes and principles of the United Nations’ within the meaning of Directive 2004/83.

The Commission proposal aligns the directive with the so-called UN “Firearms Protocol” against transnational organised crime. Today’s proposal will facilitate the tracing of civil arms and strengthen the security of trade of these arms.

Urge States to implement international humanitarian law in full, in particular by adopting national legislation to tackle the culture of impunity and to bring to justice the perpetrators of war crimes, crimes against humanity and genocide, by ensuring that international humanitarian law is fully integrated into the training programmes and operational procedures of armed forces and the police force and by ensuring during armed conflicts that impartial humanitarian organisations have secure, rapid and unimpeded access to the civilian population.

(57) Whereas, generally, armed forces stationed in a non-member country which do not come under the command of that country, international organisations and diplomatic bodies established in a third country obtain their supplies free of import duty; whereas it appears possible to take specific measures - in respect of armed forces which are under the command either of a Member State or an international organisation of which at least one of the Member States is a member, in respect of international organisations of which at least one Member State is a member and in respect of diplomatic bodies - which provide that the proof of import shall be furnished by a special document;
