In our previous opinion on ‘Interoperability as a means for modernising the public sector’ we noted that citizens were increasingly aware of, and concerned by, public administrations’ collection and usage of personal data or data collected more broadly.

Notes that the draft future Financial Regulation provides that, after consulting the Court of Auditors, agencies can appoint an independent external auditor to check whether their budget implementation complies with the provisions of the Financial Regulation; notes that the Court of Auditors would then take the external auditor’s report into account in drawing up its opinion; notes that in 2011 the Court of Auditors launched a pilot project with Eurofound (the European Foundation for the Improvement of Living and Working Conditions); considers that it would be preferable in future to avert misunderstandings of the kind that has occurred in connection with the current discharge report on the agencies, which arose from the discrepancy between what was predicted by the relevant Court of Auditors’ official at the start of the financial year and what was presented before Parliament as the final result;

Is concerned that with respect to the legal basis chosen for this envisaged agreement, the legal services of the institutions have divergent opinions, noting that the Council Legal Service is of the opinion that it is a Community competence; underlines that on this matter an opinion of the Court of Justice and an opinion of the Fundamental Rights Agency are requested for further examination of the essential safeguards and legal conditions to be fulfilled by such an agreement;

As regards the second plea, alleging infringement of Article 7(1)(b) of Regulation No 40/94, the Court noted in particular, at paragraphs 75 and 74 of the judgments in T-109/08 and T-110/08 respectively, that, in respect of the actual assessment of the distinctive character of the marks for which registration was sought, the Board of Appeal was of the opinion that the colour and matting of the glass of the bottle could not ‘function as a trade mark’ for sparkling wine.
