2. An annuity may be granted to Mr. Justice Morand under this Act only if the Government of Canada has first entered into an agreement with the Government of Ontario under which the Government of Ontario undertakes to reimburse the Government of Canada in the amount of the annuity and any other related benefits payable to him or on his behalf for the period beginning on the day he resigns his office as a judge to assume the office of Ombudsman of Ontario and continuing to the day he attains the age of sixty-five years, resigns the office of Ombudsman of Ontario or is removed therefrom by reason of being afflicted with some permanent infirmity disabling him from the due execution of that office or dies, whichever first occurs.

On the basis of that evaluation, as well as the commitments laid down in the Agreement and the guarantees provided by Canada, it is appropriate to conclude that limiting the restrictions on the introduction into the Union of the commodities to the area affected by HPAI, which the veterinary authorities of Canada have placed under restrictions due to the HPAI outbreaks in the Provinces of British Columbia and Ontario, should be sufficient to cover the risks associated with the introduction into the Union of the commodities.
