IN-CONTEXT TRANSLATIONS

Notwithstanding the provisions of Article 2 of this Annex, officials who remain in service after pensionable age shall be entitled to an increase of their pension equal to 1,5 % of the basic salary taken into account for the calculation of their pension per year worked after that age, with the proviso that the total of their pension plus the increase does not exceed 70 % of their final basic salary as referred to in the second or third paragraph, as the case may be, of Article 77 of the Staff Regulations.

The appointing authority possesses, for the purpose of considering the comparative merits of officials who are candidates for promotion, a wide discretion and in that context the Union judicature must restrict itself to consideration of the question whether, regard being had to the various considerations which have influenced the administration in making its assessment, the latter has remained within reasonable limits and has not used its power in a manifestly incorrect way.

In view of the special privileges or immunities they enjoy, the holders of diplomatic, official or service passports issued by third countries or their Governments recognised by the Member States, as well as the holders of documents issued by the international organisations listed in point 4.4 who are travelling in the course of their duties, may be given priority over other travellers at border crossing points even though they remain, where applicable, subject to the requirement for a visa.

2. Notwithstanding Article 2 of Annex VIII, officials who enter the service before 1 January 2014 and remain in service after the age at which they would have become entitled to a retirement pension shall be entitled to an additional increase of 2,5 % of their final basic salary for each year worked after that age, provided that their total pension does not exceed 70 % of the final basic salary within the meaning of the second or third paragraph of Article 77 of the Staff Regulations, as the case may be.

Thirdly, nor is it possible to accept the applicant’s arguments that he should have been recruited at a higher grade because, first, the post he occupied as a seconded national expert was regarded as ‘sensitive’ in the light of his job description, due to the particular skills required, and his functions remained exactly the same when he was appointed as a temporary agent in grade AD 5; secondly, because in December 2012 his job description was the same as those of the two other members of the same team who were officials, one in grade AD 12 and the other in grade AD 13; and, thirdly, because he was engaged as a temporary agent and recruited at grade AD 5, whilst his predecessor had been an official in grade AD 13.
En troisième lieu, ne sauraient prospérer non plus les arguments avancés par le requérant à l’appui de sa thèse, selon laquelle il aurait dû être classé à un grade plus élevé, à savoir, premièrement, que le poste qu’il occupait en tant qu’expert national détaché était considéré comme « sensible » au vu de sa fiche de poste en raison des compétences particulières requises, ses fonctions étant restées strictement identiques lorsqu’il a été nommé agent temporaire de grade AD 5 ; deuxièmement, qu’en décembre 2012 cette fiche de poste coïncidait avec celles de deux autres membres de la même équipe, lesquels étaient des fonctionnaires, l’un classé au grade AD 12 et l’autre au grade AD 13 ; et, troisièmement, qu’il aurait été engagé comme agent temporaire et classé au grade AD 5, alors que son prédécesseur était un fonctionnaire de grade AD 13.

Where the official has started to draw a pension under the pension scheme provided for in the Staff Regulations, he shall, for the purposes of Article 72 of the Staff Regulations, be treated in the same way as an official who has remained in the service until the age of 60 years".
