It is settled case-law that the principle of non-discrimination applies only to persons who are in identical or comparable situations and, moreover, requires that differences in treatment between different categories of officials or temporary staff must be justified on the basis of objective and reasonable criteria and that the difference must be proportionate to the aim pursued by the differential treatment (judgment in Afari v ECB, T‑11/03, EU:T:2004:77, paragraph 65 and the case-law cited therein).

Thus, the same or similar functions may be performed by officials or temporary staff in different grades, as is apparent from Annex I, Section A, of the Staff Regulations, which provides, for most of the functions set out therein, that they may be performed by officials in different grades.

The budgetary Chapter for officials and temporary staff shows an increase of 9.56% (+ EUR 545,120). This increase will be used to finance the full year impact of the 6 new posts granted in 2009, the costs of annual adjustments and the promotions and upgradings (3 AST and 2 AD) requested for 2010.

We must therefore fight against everything which may help to make the Commission into an uncontrollable fortress. In particular, the Council must be given back proper political control over the Commission. Cooperation in both directions between the Court of Auditors and the national courts must be reinforced in order to improve the controls in both the Member States and Brussels. The quasi-diplomatic privileges of the Commission must be removed as these hinder investigations. The European civil service must be opened up much more to specialist national officials on temporary secondment. Finally, as proposed by our Committee on Employment and Social Affairs, in an opinion which has been ignored, the possibility of financing interest groups, without prior authorisation, in part A of the budget must be completely reviewed. This currently allows the distribution of subsidies without any legal basis and encourages cronyism around the Commission.
Il faut donc combattre tout ce qui contribue à faire de la Commission une forteresse opaque au contrôle et notamment : redonner au Conseil un véritable contrôle politique sur la Commission ; renforcer la coopération dans les deux sens entre la Cour des comptes européenne et les cours nationales, afin d'améliorer les contrôles à la fois dans les États et à Bruxelles ; supprimer les privilèges quasi diplomatiques dont bénéficie la Commission et qui entravent les enquêtes ; ouvrir beaucoup plus la fonction publique européenne à des fonctionnaires nationaux spécialisés en détachement temporaire ; enfin, comme l'a proposé notre commission de l’emploi et des affaires sociales, dans un avis qui n'a pas été suivi d'effet, revoir complètement la possibilité de financer des groupes d'intérêts, sans autorisation préalable, sur la partie A du budget, possibilité qui ouvre aujourd'hui la porte à la distribution de subventions sans base légale et favorise le clientélisme autour de la Commission.
