By a decision adopted in 2007 , the Commission effectively held that the subsidies in question constituted State aid in favour of digital terrestrial broadcasters offering pay-TV services and cable pay-TV operators.

Accordingly, the Commission considers that the aid to digital terrestrial broadcasters that offer pay-TV services and cable pay-TV operators cannot be deemed compatible under Article 87(3)(c) of the EC Treaty.
