The purpose of this proposal was to take into account the resolution of the European Parliament and the results of negotiations in the Council concerning the proposal for amending the EURODAC Regulation which was adopted on 3 December 2008.[4] At the same time, it also introduced the possibility for Member States' law enforcement authorities and Europol to access the EURODAC central database for the purposes of prevention, detection and investigation of terrorist offences and other serious criminal offences.[5]

This Report responds to the requirement of Article 23(2) of the Directive 2011/36/EU on preventing and combating trafficking in human beings and protecting its victims, and replacing Council Framework Decision 2002/629/JHA, according to which: "The Commission shall, by 6 April 2016, submit a report to the European Parliament and the Council, assessing the impact of existing national law, establishing as a criminal offence the use of services which are the objects of exploitation of trafficking in human beings, on the prevention of trafficking in human beings, accompanied, if necessary, by adequate proposals".

On 19 March 2008 the Commission adopted a proposal for a Directive aimed at facilitating the cross-border enforcement of traffic offences through technical measures which will enable EU drivers to be identified and thus sanctioned for offences committed in a Member State other than the one where the vehicle is registered.

Bill C-54 proposes a clear definition of “sexually explicit material”, a definition that is consistent with its use and interpretation in the child pornography section 163.1 of the code, and voyeurism section 162 offences. The proposed new offence would clearly only apply when the material is provided for the purpose of facilitating the commission of an enumerated sexual or abduction offence against that child.

The bill also proposes consequential amendments to ensure that along with the main trafficking-in-persons offence, the proposed new offence of trafficking in children is referenced in the provisions that deal with interception of communications, exclusion of the public from court, publication bans, DNA, the sex offender registry and dangerous offenders.
