N. whereas Israeli non-governmental human rights organisations are facing a campaign of defamation, which is aimed at discrediting those speaking out against Israeli policies in the Palestinian Occupied Territories; noting that the attacks increased immediately after the publication of the Goldstone report; whereas, at the same time, the Knesset's Constitutional Committee is due to adopt a severely restrictive government-backed bill on 17 March, which would require NGOs to register as political organisations and revoke their charity status, thus restricting their ability to receive funding from foreign political entities and increasing state monitoring of the activities of NGOs;

Notes that pursuant to the procedures provided for under the Technical Arrangement currently in force between the EU and Israel, on the one hand, and between EFTA and Israel, on the other, Israel’s customs authorities and exporters already make a distinction between production operations carried out in Israeli settlements in the Occupied Territories and production carried out in the internationally-recognised territory of the State of Israel; notes that these procedures do not provide for the communication of the outcome of the distinctions made by Israel's authorities and exporters so as to enable the EU customs authorities to apply the same distinctions correctly, simply and efficiently; calls on the Commission to work together with the customs authorities of the Member States to find a solution aimed at turning this technical arrangement into a simple, efficient and reliable mechanism;

Reiterates its unconditional support for the territorial integrity and inviolability of the internationally recognised borders of Georgia, and supports the continuous efforts made by the Georgian authorities to achieve a settlement of its internal conflicts in Abkhazia and South Ossetia; welcomes the Tagliavini Report and supports its main observations and conclusions; expects that the extensive background information provided by the Report can be used for legal proceedings at the International Criminal Court and by individual citizens as regards infringements of the European Convention on Human Rights; supports the EU Monitoring Mission (EUMM) mandate; calls for its further extension and its full implementation; notes that Russia and the de facto authorities of the occupied territories, which are under Russian effective control, are blocking parts of its implementation;
13. réitère son soutien inconditionnel en faveur de l’intégrité territoriale et de l’inviolabilité des frontières internationalement reconnues de la Géorgie et soutient les efforts déployés par les autorités géorgiennes pour parvenir à un règlement de ses conflits internes en Abkhazie et en Ossétie du Sud; salue le rapport Tagliavini et souscrit à ses conclusions et observations principales; estime que les informations contextuelles importantes fournies par ce rapport pourront servir dans le cadre de procédures lancées devant le Tribunal pénal international (TPI) et qu’elles pourront être utilisées par des particuliers dans le cadre d’infractions à la convention européenne des droits de l’homme (CEDH); soutient le mandat de la mission de surveillance de l’Union européenne (MSUE); demande l’élargissement de ce mandat et sa mise en œuvre pleine et entière; note que la Russie et les autorités de facto des territoires occupés, qui sont effectivement sous contrôle russe, bloquent une partie de sa mise en œuvre;

22. Notes the recent opinion of the Advocate-General of the Court of Justice of the European Communities in the 'Brita Case', which stated that preferential treatment under the EC-Israel Agreement cannot be applied to goods originating from the occupied territories and that entitlement to preferential tariffs under the EC-PLO Agreement may be granted to goods manufactured in the occupied territories only if the requisite certificates of origin are issued by the Palestinian authorities, and is awaiting with interest the Court's final judgment; stresses that this judgment could have serious consequences on the EC-Israel and EC-PLO Agreements;

STATEMENT ON THE MIDDLE EAST Whereas the recent tragic events in Hebron, which the European Union has already condemned, should not interrupt the peace process in the Middle East, the Council of the European Union: 1. encourages the resumption of the peace process negotiations between all parties and appeals to the Security Council to adopt an appropriate Resolution swiftly; 2. while welcoming the measures recently adopted by the Israeli Government to ensure the safety of Palestinians, notes that Israel is responsible for the safety and protection of all inhabitants in the Occupied Territories; 3. appeals to the parties to discuss the question of the safety of Palestinians, including the issue of certain settlements, and to agree on appropriate measures; 4. supports the establishment, by the Security Council, in the Occupied Territories of an international presence in which the European Union declares its willingness to participate.
DECLARATION SUR LE MOYEN-ORIENT Considérant que les récents événements tragiques de Hebron, que l'Union européenne a déjà condamnés, ne devraient pas interrompre le processus de paix au Moyen-Orient, le Conseil de l'Union Européenne : 1. encourage la reprise des négociations du processus de paix entre toutes les parties et fait appel au Conseil de Sécurité pour qu'il adopte rapidement une résolution à cet effet; 2. tout en saluant les mesures du gouvernement israélien récemment adoptées en vue d'assurer la sécurité des Palestiniens, rappelle qu'Israël est responsable de la sécurité et de la protection de tous les habitants des T.O.; 3. fait appel aux parties pour qu'elles discutent les questions de sécurité des Palestiniens, y compris celles posées par certaines implantations, et qu'elles se mettent d'accord sur des mesures appropriées; 4. soutient la mise en place, par le Conseil de Sécurité, d'une présence internationale dans les T.O. à laquelle l'Union européenne se déclare prête à participer.

MIDDLE EAST PEACE PROCESS - COUNCIL CONCLUSIONS The Council noted that the Union has supported the breakthrough in negotiations made by Israel and the PLO through the immediate provision of increased assistance and its intention to provide ECU 500 million in aid for the development of the Occupied Territories in the years 1994- 1998. The Council also noted that the Union supports the development of the countries of the region within the framework of the substantial support for the Mediterranean Region as a whole under the Union's Redirected Mediterranean Policy, which amounts to ECU 4,5 billion in the years 1992- 1996. The Council recalled that some Member States had already been asked to participate in the temporary international presence in Hebron. Against this background, the Council adopted a joint action in support of the Middle East Peace Process (see Annex).
MIDDLE EAST PEACE PROCESS - COUNCIL CONCLUSIONS The Council noted that the Union has supported the breakthrough in negotiations made by Israel and the PLO through the immediate provision of increased assistance and its intention to provide 500 million ecu in aid for the development of the Occupied Territories in the years 1994- 1998, The Council also noted that the Union supports the development of the countries of the Region within the framework of the substantial support for the Mediterranean Region as a whole under the Union's Redirected Mediterranean Policy, which amounts to 4.5 billion ecu in the years 1992- 1996, The Council recalled that some member states had already been asked to participate in the temporary international presence in Hebron Against this background the Council adopted a joint action in support of the Middle East Peace Process (see annex).

While noting that the events have been condemned by the Israeli Government, the European Union holds that the authorities in the occupied territories must take full responsibility for protecting the inhabitants; the Union also calls for a full and immediate inquiry into the circumstances of the massacre.
Tout en prenant acte de la condamnation des événements par le Gouvernement israélien, l'Union Européenne considère que les autorités dans les territoires occupés doivent assumer toute responsabilité afin d'assurer la protection des habitants; l'Union demande aussi qu'une enquête immédiate et complète soit faite sur les circonstances du massacre.
